From Boston.com, MHProNews.com learns that the highest court in Massachusetts has approved the expansion of an MH community in the town of Shirley. The court determined local zoning regulators used concerns about traffic and density as pretexts to squash the project. The town, the court determined, cannot apply zoning bylaws for single-family homes to “mobile home parks.” The case began when the owners of the Wayside Mobile Home Park applied for a special permit to expand from 65 to 79 homes. Shirley is a town of about 7,000 35 miles northwest of Boston. In 1985 the town eliminated “mobile home parks” as a permitted usage in all districts, but Wayside was grandfathered in.
