The Western Manufactured Housing Communities Association (WMA) puts out a brochure on elder abuse and seniors’ rights. It’s not strong, but it is linked here. From that is the following.

Those are reasons enough for prudent investors to sit up and take notice.
There is this definition from FindLaw. The bold text is added for emphasis.
But behind the curtain of such facts is this. Certain business and association practices are arguably resulting in rises in site fees at rates that professionals should logically be able to anticipate will be harmful to significant numbers of seniors and others. The harms can be emotion stress that impacts health as well as financial stress that can also impact healthcare decisions. Who says? Among others, those residents who told their stories to the FHFA at the recent listening sessions that included Fannie Mae and Freddie Mac.
With that in mind, one should ponder the kinds of disclaimers and business practices that foster harm to customers current and future.
It is not easy to imagine a good reason for most independent businesses and the general public good for thwarting production and development of new manufactured home communities and more manufactured housing. Yet, there is consistent and at this point un-contradicted evidence that this is what is occurring in manufactured housing.

- Possibly attorneys representing such operations
- Board members of such operations
- Investors
- Public officials
are among those that should be concerned about the implications of years of failure to thwart good existing laws.
But there may be more.
What about the issue of Vexatious litigation?
Wikipedia says that “Vexatious litigation is legal action which is brought solely to harass or subdue an adversary. It may take the form of a primary frivolous lawsuit or may be the repetitive, burdensome, and unwarranted filing of meritless motions in a matter which is otherwise a meritorious cause of action. Filing vexatious litigation is considered an abuse of the judicial process and may result in sanctions against the offender.”
When a community operator uses or threatens legal actions in connection with issues – rent control or others – that spring from business and association practices or failures to act, that may raise yet other legal concerns that could put certain law firms’ practices in potential jeopardy.
