As a Manufactured Housing Institute (MHI) op-ed by their CEO Lesli Gooch, Ph.D., that follows revealed, they are once more claiming “momentum.” This time that claim applies to  what Gooch asserts is MHI “momentum” with public officials in Washington, D.C. As multiyear readers here may recall, MHI made a similar claim of “momentum” when they touted the launch of their arguably market failed CrossMod^TM homes initiative. Following that Clayton Homes supported MHI trademarked plan claim of ‘momentum’ manufactured housing production and shipments went into a 2½ year decline. That decline ended due to the extreme post-COVID19 housing boom, not due to anything that MHI can be credited with. Against that brief backdrop, by pairing two letters attributed to Gooch, and then comparing it to known facts, results in stark contrasts between MHI statements and the reality of the industry for independents.

As part of the fact check, analysis and expert commentary that precedes and follows Gooch’s claims and statements, the following introduction to her two recent op-eds are useful. Note that both HousingWire and MHInsider are apparently friendly platforms to MHI messaging. How can that be known? Simple. HousingWire Editor Sarah Wheeler, after agreeing to accept an op-ed by this writer that critiqued Gooch then declined running it. More recently, with respect to the Gooch missive below, Wheeler declined replying. De facto, HousingWire is an apparently friendly mouthpiece for MHI to publish claims without critiques. MHProNews has previously documented the cozy relationship between MHI, MHVillage, and MHInsider.

In days and years gone by, this publication was a member of MHI. This writer and MHI team members observed the organization up close and personal over the course of years. MHI used to compensate this publication for certain publicity items. MHI, they’re chairmen, and others in the that orbit gladly replied in short order to requests for comment. But roughly 5 years ago, that began to change. Now, they routinely avoid any direct response. Given that MHI’s outside attorney Goch once claimed that MHI wants robust debate so that authentic consensus is achieved, what happened?

MHI in their apparent posturing fails to mention that the Manufactured Housing Association for Regulatory Reform (MHARR) exists. Yet, it was MHI corporate leadership in the late 1990s that caused a pivot at the staff level which led MHI to team up with MHARR to get what became the Manufactured Housing Improvement Act of 2000 (MHIA or 2000 Reform law) enacted. Is MHI’s institutional memory too short to remember that it was after MHI teamed up with MHARR, the Texas Manufactured Housing Association (TMHA), and other state associations working in concert that led to the enactment of the MHIA. If MHI is serious about the concerns Gooch raised in the second op-ed below, why are they ignoring proven history and deliberately failing to work with MHARR?

MHI Keeps Manufactured Housing on the National Agenda

Policymakers in Washington are keenly focused on ways to address the nation’s affordable housing supply shortage. The need for immediate solutions is only increasing — in 2021, home prices increased by more than 18% while “real” average weekly earnings for U.S. workers fell by more than 3%. With housing inventory at near historic lows and economists estimating more than five million homes are needed, finding ways the federal government can help spur additional affordable housing supply is at the top of the agenda. The Manufactured Housing Institute is working to ensure manufactured housing is well-positioned to be at the forefront of these deliberations.

Talk of Manufactured Housing at the Capitol

Last September, the Biden-Harris administration directed federal agencies to use “every tool available in government to produce more affordable housing supply as quickly as possible.” Manufactured housing supply was a leading component of this effort, with White House Press Secretary Jen Psaki highlighting the administration’s commitment to boosting the supply of manufactured housing. Beyond Washington, the plan included calling on state and local governments to reduce zoning and financing barriers to manufactured housing which “allows families to achieve homeownership and build wealth.”

This is a historic time for our industry when our efforts in Washington continue to yield attention at the highest levels of government to help more Americans achieve homeownership through manufactured housing. As a result of the White House directive, an inter-agency task force has been convened to look at federal homeownership financing programs and how they can better support the purchase of manufactured homes.

With current HUD Secretary Marcia Fudge pledging her support of manufactured housing at numerous congressional hearings, saying it is an “outstanding option,” MHI’s efforts to educate policymakers has positioned us to ensure federal efforts to increase the affordable housing supply in America will include changes in policy that support manufactured housing. In addition, to support by administration officials, MHI has worked to ensure that the benefits of manufactured housing are a topic at every affordable housing hearing that has taken place in the 117^th Congress.

We are not just cultivating relationships with those congressional representatives that already know us.. We are taking our message about the quality and affordability of manufactured homes to congressional leaders, including many who have never seen a manufactured home but want more quality affordable homeownership options in their districts.  Our efforts have yielded results and through our advocacy, we have support from congressional members on both sides of the aisle and from all parts of the country – saying at hearings that manufactured housing is “the most affordable homeownership option available nationwide” and “manufactured housing offers a safe and affordable, wonderful, place for a family to call home.”

Seize the Opportunity

Now is our time, and MHI is seizing the opportunity to advance key priorities to grow the market, including ensuring federal housing finance programs (FHA, Fannie Mae, Freddie Mac, USDA, VA) support manufactured housing; updating the HUD Code on a regular cadence; making sure efforts to increase energy efficiency standards for manufactured housing are feasible and cost-effective; moving the federal government to address local exclusionary zoning policies and enforce the preemption of the HUD Code; and supporting the preservation of land-lease communities.

In addition to our direct work with federal policymakers, MHI’s membership has served as a key grassroots connection to elected representatives and regulators. Since the beginning of the 117^th Congress and the Biden Administration, we have generated more than 1,500 contacts to the administration and Congress. Our advocacy has resulted in the first update to the FHA Title I program in 40 years; the first comprehensive updates to the HUD Code in decades; the Senate telling HUD to expedite further updates to the HUD Code and further FHA financing reforms; House members telling the Department of Energy they do not support the proposed efficiency rule; and administration efforts to address lumber prices and supply chain shortages. MHI is also developing partnerships with key national housing and business coalitions to ensure industry priorities are embraced by the advocacy community so that our voice to policymakers is even stronger. Through these relationships, MHI has participated in numerous housing industry events, including the National Association of Realtors® December “Real Estate Forecast Summit: The Year Ahead.”

MHI is continuing to build upon our momentum from 2021 so that we can continue to elevate housing innovation and expand attainable homeownership. We will continue to build relationships with federal policymakers and ensure the manufactured housing industry continues to be a part of the federal dialogue about addressing our nation’s housing challenges. Our access to Washington policymakers is as strong as ever and it is bolstered by the direct engagement from MHI members to their elected representatives to keep our issues at the forefront.

That string of statements and claims by Gooch for MHI sounds impressive, doesn’t it?

The problem is that it Gooch’s claims are contradicted by other facts, information, and even other MHI statements. Ironically,  among the most potent contradictions of her rosy claims above are not from an MHI critic, but rather from Gooch herself. For evidence, see what she said below. Her next op-ed makes it clear that the above is mostly frothy spin, or smelly BS.

MHI and Gooch can’t have it both ways. If they are so effective in Washington, then why did Gooch have to change her tune in the same month both of these two op-eds were published? But even after self-contradictory claims, Gooch tries below to posture MHI as a savior for manufactured housing from what she admits is a costly and looming problem.

Restated, after touting their stronger than ever relationships and “momentum” in Washington, Gooch admitted below that “it is disappointing that the final rule for manufactured housing energy standards that the Department of Energy (DOE) released just two days later does precisely the opposite” of what the Biden White House statement promised on manufactured housing or housing in general.

Additionally, as MHProNews spotlighted by using HUD Secretary Marcia Fudge’s own words captured on video by CSPAN, Fudge may provide Gooch some nice sounding phrases that MHI can then spoon feed to trusting members. But the troubling reality is that Fudge shot down MHI’s supposed support for the claim that the Manufactured Housing Improvement Act (MHIA) of 2000 (sometimes called the 2000 Reform law) and enhanced preemption. MHI can’t have it both ways. Who does Gooch think she is fooling? Or is Gooch illustrating the wisdom of honest Abe Lincoln, who said that no person has a good enough memory not to get caught in their own lies? Both classic Lincoln quotes below seem to apply to what’s occurring in manufactured housing.

Against that backdrop is the following on HousingWire. As in the above, highlighting is added by MHProNews, but Gooch’s text remains unchanged.

 

Opinion: A more balanced approach to manufactured home energy efficiency

New manufactured housing energy standards would actually increase the burden of housing costs

The Manufactured Housing Institute (MHI) appreciates that the Biden administration has created a White House Task Force on Manufactured Housing. We also commend the administration for the White House initiative announced a week ago Monday to “Ease the Burden of Housing Costs,” which a Housing Wire article noted is designed to reduce regulatory hurdles.

So, it is disappointing that the final rule for manufactured housing energy standards that the Department of Energy (DOE) released just two days later does precisely the opposite. It would actually increase the burden of housing costs. The final DOE rule even acknowledged that it would raise new manufactured home prices.

Manufactured housing is by far the most affordable homeownership option in America. The industry is building quality affordable homes that are already energy efficient and resilient.  However, by any objective analysis based on the real-world impact on actual homebuyers, the annual cost burden from those price increases will exceed the speculative energy savings that DOE hopes will take place.

Both the standards and the underlying methodology used to develop them are fundamentally flawed. EISA, the underlying statute behind the standards, was clear. The standards were required to take into consideration current manufactured housing construction methods and transportation requirements for homes built in a factory and transported to the site. At best, this was merely given lip service.

EISA was also clear that the IECC, the site-built building code, could only be used if proposed energy standards were “cost effective,” and further that DOE was required to consider iterative proposals to find the standard that is most cost effective.  But this too did not happen.

Instead, the DOE standards relied on speculative home price appreciation assumptions a decade later — while ignoring that in the real world, increased annual mortgage costs to actual homebuyers as a result of the higher prices would exceed projected energy savings. It ignored that in the real world many potential homebuyers would no longer qualify for a mortgage to buy a home because of the higher prices.

Arguably, these flaws stemmed from DOE’s failure to follow the EISA statutory requirement to consult in a meaningful way with HUD — the federal agency with housing expertise — in developing the standards.

Fortunately, there is still time to sort these issues out. The DOE rule established a one-year implementation period. More importantly, HUD — the very agency DOE should have relied on for affordability expertise — should have the final say before the standards can become effective.

Under the 2000 Manufactured Housing Act, all manufactured housing construction and safety standards (including energy requirements) are governed by the HUD Code. And, HUD, acting on recommendations by its Manufactured Housing Consensus Committee, has exclusive authority under the HUD Code.

So, . Moreover, they shouldn’t take effect until the DOE standards and the HUD Code are reconciled, since manufacturers should not have to sort through two standards.

There is “Manufactured Housing Affordability and Energy Efficiency Act of 2022” – that clarifies all these points. Adoption of this bill would further ensure that these new manufactured housing energy standards do not come at the expense of manufactured housing homeownership affordability.

MHI supports energy-efficient manufactured homes. In MHI’s comment letter, we did not just criticize the DOE draft rule, we offered a cost-effective alternative proposal that balances homeownership affordability and energy efficiency. As HUD considers energy efficiency standards generated by DOE, we strongly urge adoption of a more balanced proposal along the lines MHI put forth in our comment letter.

As this process goes forward, MHI would also like to see other loose ends tied up. A recent court case, Louisiana vs. Biden, raises serious questions as to the legal validity of the DOE standards, since they seem to be based on the same methodology that the judge in that case ruled were invalid.

The DOE standards also failed to address a fundamental flaw in the underlying EISA statute, which is that the enforcement mechanism authorizes penalties that are based on the term “retail list price.” No such metric or term exists in manufactured housing, and the final rule did not address this flaw. Confusion among manufactured home manufacturers and retailers about issues like this would impede the use of manufactured homes as our nation’s most affordable homeownership option.

Another question: is DOE going to be responsible for determining whether the standards are being complied with, even though HUD has responsibility for manufactured housing and construction safety standard compliance under the HUD code? Or is HUD responsible for determining compliance for DOE standards?

This are just a few examples of the folly of making critically important housing affordability decisions without a direct, active role for HUD, the federal agency which has housing expertise and housing affordability as its mission.

MHI looks forward to working with HUD and other parties to get this important standard right as we face the twin challenges of housing affordability and energy efficiency. ##

There was no timeline or no word-count limit, per Wheeler’s email. But despite multiple follow ups, the op-ed submitted by this MHProNews writer, which is linked here, was not published. Nor were there any replies from Wheeler or her colleagues. These facts beg the question: has Wheeler de facto given cover to and favored Gooch and MHI over evidence of other voices with a very different viewpoint than hers within manufactured housing? See the report linked below.

 

The Manufactured Housing Institute (MHI) leaders, or even attorneys working for MHI, routinely fail to respond to inquiries from skeptics or critics. Who says? It is revealing that the voices that make such points directly or by inference include several of MHI’s members.  It includes the now co-president of MHVillage/MHInsider, Darren Krolewski.  He said there is more bad new than good news and that this is a factor stunting the industry’s potential.

Former MHI Chairman, and still an MHI board member Tim Williams, President and CEO of 21st Mortgage Corporation, admitted there was a problem with MHI getting their message out. Be that as it may, what Williams didn’t say is that MHI failed to get their bill passed. MHI has a PAC that they’ve bragged about for years.  But where are the measurable results from MHI PAC? Or MHI’s Gooch’s various media engagements?

If MHI is as impressive as they claim, if they truly have “momentum,” then why hasn’t the industry collectively achieved the 500,000 production level that MHI’s prior president and CEO said ought to be the goal?

Accountability?

Performance for organizations and leaders can often be measured by looking carefully and objectively at the facts and claims that were previously made. That is the basis for Berkshire Hathaway Chairman Warren Buffett’s remark about the importance of the rearview mirror.  When Rick Robinson was still the general counsel for MHI, a state association executive (think MHEC member) that was an MHI affiliate told MHProNews that Robinson contacted that person about concerns that the exec had merely forwarded emails from MHI to MHProNews. Does that sound like normal behavior for a national trade group to engage in? Nor was that a one-off. Several state execs told MHProNews that Williams strong-armed skeptical MHI state affiliates into supporting what became the multi-year, multimillion dollar wasted effort to enact the never-passed Preserving Access to Manufactured Housing Act. 

Preserving Access became the poster-child for MHI’s claims and boasts that never came to pass.

MHInsider and HousingWire have each provided a platform for the Manufactured Housing Institute (MHI) to provide their CEO’s Lesli Gooch’s viewpoints without meaningful opposing views. In the case of MHInsider, the apparent connections between their parent company, MHVillage, and MHI/leaders arguably makes the MHInsider little more than an unofficial mouthpiece for MHI propaganda. Given the benefits MHVillage gets from the relationship, their towing the MHI line is perhaps more understandable than HousingWire’s de facto stance in favor of MHI and Gooch. Where is their laundry list of MHI’s or Gooch’s measurable accomplishments?  The irony is looking at the facts and evidence and comparing it to MHI and Gooch statements reveals that MHI has over 2 decades of failure at achieving their own claimed goals.

MHI said in the above that they have as much or more access to policy makers and elected officials as ever. They said their policies are working. Really? If so, who is routinely benefiting, other than consolidators of the industry? MHI can’t have it both ways. If their policies are “working” does that mean working against the industry’s independents and most consumers? For those who need more evidence of the disconnects between MHI/Gooch claims and the objective reality of MHI’s failed performance in the 21st century, open up the quote graphic below and see for yourself the contrast between reality and MHI’s claims of performance, momentum, and success at achieving their claims.

display in the light of statements that include their own members and leaders, as well as others,
on the finance issue. Something similar could be applied to other pending issues MHI has apparently

failed to achieve after years of posturing, promises, and performance art.

Let’s sum up, weaving in more linked facts and draw to a conclusion.

• MHI can’t have it both ways. If they were truly effective, then this DOE rule would not currently be counting down to full enforcement.
• If MHI were truly effective and were planning ahead (vs. darkly posturing to lull trusting souls), they would have entered into the only effort that Gooch admitted had worked so far, litigation. MHARR was working in support of Louisiana vs. Biden, which Gooch cited but failed to give MHARR credit. Why didn’t MHI join in? Why don’t they use the courts now, arguing the very concerns Gooch outlined?
• If MHI were looking ahead why did the launch a bill without Democratic co-sponsors? A third-party analysis of the MHI backed bill referenced by Gooch said it has a 1 percent chance of becoming law. That makes the bill mere window dressing – lip service, to borrow Gooch’s slur on the Biden Administration and apply it to themselves – because it will go nowhere.

Manufactured Housing Institute CEO Lesli Gooch Said Final Manufactured Housing Energy Rule ‘Undermines’ Biden Admin Claims on Easing Burden of Housing Costs, Contradictions Emphasized; plus MHMarkets Update

• MHI alludes to the charge leveled by MHARR that MHI tossed “a lifeline” to DOE.  MHProNews has used MHI’s own words and documentation obtained from the DOE to demonstrate that they have worked for years to backstab the independents of the industry. One must keep in mind that the largest brand at MHI is Clayton Homes, which now has a site-built division and has for years.

• Not that MHProNews is endorsing MHI member emeritus George Allen, but that ‘contributing editor’ for MHInsider has stated that unrest is growing among members who feel ‘disenfranchised’ at MHI. Like it or not, Allen’s claim fits MHProNews/MHLivingNews’ multi-year thesis that MHI is working for industry consolidation, and not for the interest of ‘all segments’ of the industry as they claim. This opens them up to various legal liabilities and risks. Who says? Samuel Strommen at Knudson Law.

• Some have argued that MHI needs an off-ramp to save face and allow for a pivot. That is explored in the report linked below.
