Manufactured housing production increased in May 2024 over April 2024, according to the July report issued yesterday (7.8.2024) by the Manufactured Housing Association for Regulatory Reform (MHARR). But a closer look at the data and related events reveals cracks, weaknesses, and apparent flaws in manufactured housing industry performance among many corporate, nonprofits, and advocates. The reason that this matter is because the U.S. affordable housing crisis demonstrably can’t be mathematically solved without millions of more affordable homes. To better understand the issues that relate to the years of manufactured home industry underperformance, particularly in the 21st century, it is useful to look back and see how manufactured housing evolved from the trailer houses and mobiles homes from the decades before the HUD Code became federal law. Zoning and other legal/political and regulatory issues will also briefly be examined in a historical outline provided further below.

Part I of this report provides the Washington, D.C. based MHARR monthly update on manufactured home production, including the top states for new HUD Code manufactured home shipments.

Part II of this report offers additional related information on the most proven form of permanent affordable housing in the late 20th and early 21st century with more expert analysis and commentary. It includes the information provided from the Manufactured Housing Institute (MHI) released on 7.3.2024.

MANUFACTURED HOUSING PRODUCTION INCREASES IN MAY 2024

Washington, D.C., July 8, 2024 – The Manufactured Housing Association for Regulatory Reform (MHARR) reports that according to official statistics compiled on behalf of the U.S. Department of Housing and Urban Development (HUD), HUD Code manufactured housing industry year-over-year production increased once again in May 2024. Just-released statistics indicate that HUD Code manufacturers produced 9,408 new homes in May 2024, a 19.5% increase over the 7,869 new HUD Code homes produced in May 2023. Cumulative production for 2024 now totals 42,656 homes, a 19.4% increase over the 35,719 HUD Code homes produced over the same period in 2023.

A further analysis of the official industry statistics shows that the top ten shipment states from January 2023 — with monthly, cumulative, current reporting year (2024) and prior year (2023) shipments per category as indicated — are:

Part II – Additional Information with More MHProNews Analysis and Commentary

Some historical context is often useful to understand how the nation, and our profession’s role in it, got into its current dilemmas.

Provide a historically accurate snapshot of the early evolution of trailer houses in the 1930s and 1940s that were used in part to meet the production needs of the nation, and the development of post-World War II era trailer parks. Then provide a textual (verbal) snapshot of the evolution of trailer houses into larger “mobile homes” in the 1950s into the early 1970s. Explain that while many producers of mobile homes met ANSI or other standards, some builders built inferior product that might include too little insulation, fire safety risks (like aluminum wiring, which for a time in that era was also used in conventional site built housing and apartments) that yielded some tragedies that were used as part of the push for the national standards that became the HUD Code enacted by Congress in 1974 and which went into effect on June 15, 1976. Explain that Congress during the term of President Richard Nixon provided financing support for FHA Title I loans for mobile homes which evolved into the early post HUD Code manufactured homes of 6.15.1976. Staying in historical flashback mode for a bit longer, at one time, mobile home production soared over 500,000 new homes.  During that era, Danny Ghorbani worked with the what today is the Manufactured Housing Institute (MHI). The precursor to the Manufactured Housing Institute (MHI) was the Mobile Home Manufacturer Association. It was that trade group that was addressed by Ford.  As the RV MH Hall of Fame recognized, back when Ghorbani was with what became MHI, Ghorbani helped develop hundreds of thousands of sites for mobile homes-turned manufactured homes. Ghorbani later broke from MHI and helped form what became the Manufactured Housing Association for Regulatory Reform (MHARR).  As MHProNews has periodically informed and reminded readers, back in the heyday of the industry, factory-built housing was literally reaching for the sky with designs for high-rise structures that could hold hundreds of mobile homes/manufactured homes. Be it ‘single family’ mobile and manufactured homes or other designs, there was a diversity of product far broader in evidence in the industry. More producers naturally lead to a diversity of products, that nevertheless still has to meet during the post-HUD Code era the construction and safety standards of the industry. Consumers had more choices and a broader range of price-points.  The industry was so robust in the past that President Jimmy Carter’s brother was personally involved in the manufactured housing industry.

At the time Belsky made this prediction that MHI previously highlighted, manufactured homes were selling over 250,000 new units per year. This year, at the current pace, manufactured housing might reach about 40 percent of that pace. Supreme Court Ruling Deals Blow to Bureaucratic Overreach

In a landmark decision on Friday, the Supreme Court overturned Chevron v Natural Resources Defense Council. Under Chevron, if a law granting a federal agency the power to enact regulations is later determined to be ambiguous, then courts would defer to the federal agency’s interpretation of the law when the federal agency’s regulations are reasonable. Thus, courts were required to defer to federal agencies when interpreting certain regulations.

Under Friday’s 6-3 decision overruling Chevron, courts are no longer required to give deference to an agency’s interpretation of regulations. Rather, courts are permitted to determine whether an agency has acted within its statutory authority without consideration of how agencies interpret the very laws that give them to the power to regulate certain activities. Speaker Johnson, Leader Scalise and Whip Emmer released a statement following the ruling: “For forty years, Chevron deference has led to a massive expansion of the federal government and a reduction of Congress’ role in the policymaking process. Chevron upended the separation of powers between our three branches of government and is responsible for many of the burdensome regulations that stifle progress and curtail liberty. Today’s landmark decision by the Court restores the balance outlined by the Founders in our Constitution and represents the beginning of the end of the administrative state.”

MHI is evaluating how this decision will favorably impact its ongoing litigation with the Department of Energy.

15) What has to be grasped is what MHARR has aptly called “the illusion of motion.” MHI is constantly doing stuff, routinely holding meetings, they issue memos, industry overviews, and position papers that may look good, but which later disappear. It sounds much like a page from Orwell’s 1984 where the “memory hole” erased history that proved inconvenient. There is plenty of duplicity to go around among numbers (but not all) individuals and groups.

16) But what is difficult to avoid is the point that MHProNews and MHLivingNews has repeatedly pointed out. Namely, since Warren Buffett led Berkshire Hathaway (BRK) entered the manufactured housing industry, there was a brief blip during the post-Katrina era where manufactured housing rose to a level that briefly surpassed the size of the industry after they purchased Clayton Homes and their associated lending. It should be recalled that Clayton at that time also had land-lease communities. Buffett, per sources, wanted those communities spun off because he didn’t want to be seen as ‘raising the rents on grandma.’  But that didn’t keep him and his brands from profiting from those tactics. Brokering communities, financing communities, are among the profit-generating activities performed by Berkshire-linked entities.  What today is Yes! Communities, one of the firms named in antitrust suits for aggressive, had a key part of its origin in the land-lease communities spun off by Clayton Homes.

Before MHAction, the older NMHOA trade group filled a similar role. Evidence exists to support the notion that funding to NMHOA can also be traced via so-called dark money channels back to Warren Buffett connected nonprofits/foundations. This pattern of Buffett bucks playing both sides (i.e.: MHI on the one hand, and consumer advocacy groups on the other) off against each other may or may not have been known to those carrying out their ‘duty’ to their donors.
