The Manufactured Housing Institute (MHI) responded favorably to the Department of Housing and Urban Development’s (HUD) revision of “Subpart I-Consumer Complaint Handling and Remedial Action.” MHI welcomes and agrees with many of the alterations made by HUD regarding the inspection, record-keeping and assignment of responsibility for any problems that occur with new manufactured housing once it is placed on the consumer’s home site. MHI said the previous regulation placed responsibility on the manufacturer for problems not of the manufacturer’s doing, but the revised regulation gives more guidance in general and clears up a number of ambiguities. Much of the discussion centers around terminology issues more than substantive ones. MHI would like more clarification about what constitutes a “reasonable” investigation in case of a possible defect.
