Leagle reports Manufactured Housing Communities of Arizona, Inc. (MHCA), an organization representing community owners, is suing Gene Palma, the Director of the Arizona Department of Fire, Building and Life Safety. MHCA seeks to overturn a ruling requiring the owners of Cherokee Village MH and RV Park to reimburse home owners for improving natural gas lines. In a previous ruling, a superior court had denied the director’s motion to dismiss the suit because Cherokee Village owners successfully said the statue of limitations had expired. The director says MHCA has no standing, the claim is not justiciable, and neither he nor the department can be sued. Located just east of Phoenix, Cherokee Village has 149 homesites. The suit will be heard in the Arizona Court of Appeals.
