In the Topsy Turvey oddly touted by Joe ‘Bidenomics‘ land, journalists and publishers with op-ed capacity have day to day decisions to make on heartbreakingly vexing topics like this headline issue involving the Manufactured Housing Institute (MHI) letter with a coalition of 17 other nonprofit housing organizations. Millions are struggling to afford rents. When those in that troubled scenario can’t make ends meet, some will call on public officials to act. That press of stressed renters and their supporters is an apparent part of the background of the letter from that housing nonprofits coalition dated 8.10.2023 letter to Sandra Thompson, director of the Federal Housing Finance Agency (FHHA), attached further below. Most of that letter by MHI et al could technically be true. But their coalition letter nevertheless omits or downplays several significant topics.

For example, why isn’t MHI getting that same housing coalition’s support to press FHFA for true Duty to Serve (DTS) enforcement that includes robust chattel as well as parity in land home lending support for manufactured housing?

Why doesn’t “got clout?” MHI 2.0 get that same housing coalition to press HUD Secretary Marcia Fudge to implement the long overdue implementation of the so-called “enhanced preemption” provision of the Manufactured Housing Improvement Act (MHIA) of 2000?

Why didn’t MHI sign onto the consumer coalition that wanted more affordable chattel lending for manufactured home buyers?

Or regardless of the economic arguments and data that they raised, what about the political pressures arising from the economic pressures on millions of everyday Americans, the vast majority of whom aren’t keeping pace with inflation? With U.S. credit card debt hitting record highs, there is only so long that millions can keep borrowing to meet day to day needs. It is with those and other factors in mind that MHProNews provides the latest entirely predictable crisis in Bidenomics America, where Bidenflation is caused by borrowing money for programs that don’t accomplish their purported goals and wars that are unlikely that be won. With a de facto open southern border, it’s obvious that population growth beyond the capacity of site builders to cope with in the current regulatory and economic environment is illustrated by New York City’s Mayor Adams asking for $12 billion dollars of federal money to cope with their illicit border-jumping migrant crisis. An array of problems exist that must each be dealt with. Will MHI tell our industry most of those politically incorrect realities? They haven’t yet, so why should we think they will start now?

Part I

Broad Coalition of Housing Providers and Lending Associations Warns FHFA Against Rent Control

WASHINGTON–(BUSINESS WIRE)–Eighteen associations representing housing providers, lenders and residents today sent a letter to Federal Housing Finance Agency (FHFA) Director Sandra Thompson warning that mandatory rent control and rent stabilization policies will increase rents, reduce the capital needed to boost the supply of housing, and ultimately hurt current and future renters.

As FHFA considers changes for Fannie Mae and Freddie Mac-backed multifamily properties, the groups cautioned that rent control mandates will exacerbate the housing affordability crisis and that the best way to ease rising rents is to create voluntary incentives within Fannie Mae and Freddie Mac programs to expand the supply of much-needed affordable housing.

The signatories asked FHFA to reject imposing rent regulation as a condition of Fannie Mae and Freddie Mac-backed financing and instead, create additional voluntary incentives within the GSE programs to expand the supply of needed affordable housing.

Research has proven repeatedly that mandatory rent control is a failed policy, which does nothing to alleviate the root causes of housing affordability issues—namely the fact that our nation’s housing supply has not kept pace with the needs of our growing population. Rent stabilization disincentivizes rental multifamily housing investments across markets, particularly in communities of opportunity that already often have few affordable options.

Moreover, rent regulation is not equitable as it does not target lower- and moderate-income renters that are in most need of assistance, support and stability. Instead, it incentivizes current renters to remain in place for longer periods of time and disincentivizes additional investments in housing, thereby limiting opportunities for others who do not have access to the rental housing market in favor of those that already do. This inequitable approach most impacts people of color who already have limited access to many housing markets, especially those with good schools, nearby public transportation and other amenities.

Implementing rent control would be contrary to the goal and mission of Fannie Mae and Freddie Mac to creating more affordable housing opportunities for low- and moderate-income residents. In fact, a February 2022 study indicated that only 27 percent of firms surveyed said that they would be willing to keep their current investments, or add new ones, in rent-controlled markets.

As FHFA considers policy reforms, rather than instituting counterproductive rent control measures, we strongly urge the agency to expand programs that increase the supply of housing, lower housing costs and enhance housing equity and availability.

The undersigned national real estate associations represent a broad coalition of housing providers and lenders that are committed to working together with the Federal Housing Finance Agency (FHFA) and the Enterprises to address America’s housing affordability crisis. Unfortunately, we face serious obstacles in addressing rising housing costs and delivering much-needed supply. As you consider changes for Enterprise-backed multifamily properties, we write to share our strong concern that rent control and rent stabilization policies that have been proposed have proven time and time again to increase rents, reduce the capital needed to boost the supply of housing, and ultimately hurt renters today and in the future. We ask that you reject imposing rent regulation as a condition of Enterprise-backed financing and instead create additional voluntary incentives within the GSE programs to expand the supply of needed affordable housing.

Research has proven repeatedly that rent control is a failed policy which does nothing to alleviate the root causes of housing affordability issues—namely the fact that our nation’s housing supply has not kept pace with the needs of our growing population. This is contrary to the Enterprise’s goal of creating more affordable housing opportunities for low- and moderate-income residents. In fact, a February 2022 study indicated that only 27% of firms surveyed said that they would be willing to keep their current investments, or add new ones, in rent-controlled markets.[1]

FHFA and the Enterprises should consider that rent control is nothing more than a politically expedient response to the increased cost of housing and other essential goods and services, and it results in a reduction of the available supply of rental housing and increases costs especially for those most in need. In a San Francisco case study, for example, the National Bureau of Economic Research (NBER) found that rent control “reduced rental housing supply by 15%, causing a 5.1% city-wide rent increase.”[2]

We share the FHFA’s commitment to addressing the affordable housing crisis in our nation. Our organizations have long been strong supporters of voluntary programs supported by the Federal government, including the Low-Income Housing Tax Credit (LIHTC), expansion of the Section 8 programs, and the Enterprises programs that provide the financial resources necessary for developers to create more affordable units. Unfortunately, only 1 in 4 Americans that need housing subsidy receive it, as not nearly enough resources have been invested in these voluntary efforts over time, resulting in a particularly severe shortage of affordable housing. We call on Congress, FHFA, and the Enterprises to dedicate more funding and resources for programs that provide assistance to those families in need and in programs that have the potential to increase development and preservation opportunities for low-and moderate-income households who need it the most.

Implementing failed policies such as mandatory rent control will create instability in an already challenged market and undermine the important goals of fostering a healthy and equitable housing market, increasing supply, and creating successful communities where people of all backgrounds can build their lives. As such, we respectfully encourage FHFA to refrain from implementing policies like rent control on private rental housing providers and instead focus on leveraging federal resources in the form of incentives to bolster new affordable housing.  Sincerely,

Two Possibilities?

There appears to be two possibilities. MHI has asked that coalition for such support on the “DTS” and “enhanced preemption” issues. MHI hasn’t made such an ask.

  • If MHI hasn’t asked, why haven’t they done so? Restated, why is MHI helping mainstream conventional housing associations without getting similar support in return?
  • If MHI has asked for such support, why haven’t they got the kind of support that MHI is giving them on issues like the above?

Meaning, whatever the situation may be – MHI has or hasn’t asked – what is clear is that there has been no known evidence of a similar document from 17 other housing nonprofits weighing in with MHI to get support for DTS and “enhanced preemption.”  Some evidence via a Bing AI chat inquiry by MHProNews is warranted.

MHI for some time used the image below asking: “got clout?” They then asserted that industry members could “get it here” – meaning, get it at MHI. After MHProNews repeatedly pointed out the nonsense of that claim, in part by pairing it with the classic Wendy’s “where is the beef?” commercial, MHI quietly dropped it. Fact checks and pushback does yield some minor to significant victories.

 

 

It is simply not plausible that if MHI sincerely wanted to work for ‘all segments’ of the industry that they would routinely behave in a fashion that benefits consolidators and may not benefit others.
