Gov. J.B. Pritzker (IL-D) Signs Manufactured Home Legislation into Law, Will Other States Follow? What State Association, Manufactured Housing Institute, Consumer Groups Each Did; plus MHMarkets
Governor J.B. Pritzker (IL-D) signed dozens of bills on 7.19.2024, including legislation related to manufactured housing in that state. According to The Center Square: “Illinois Gov. J.B. Pritzker signed 68 bills Friday that affect drivers, those who violate immigration laws, victims of child abuse, mobile homes and more.” Specifically, that news source said: “Newly built manufactured homes must have weather radios installed beginning Jan. 1, 2025 with House Bill 5238. The measure also promotes regular maintenance of safety devices in mobile home communities.” Because this is a post-production issue, the Manufactured Housing Improvement Act (MHIA) of 2000 is unlikely to apply. That means that the Illinois Manufactured Housing Association (IMHA) should be first up on the issue for the industry, with the Manufactured Housing Institute (MHI) hopefully acting in support. But as this report reveals, there is no apparent evidence that IMHA opposed this publicly. Weather radios aren’t required for conventional housing. Why should they be required for manufactured homes in IL? There is more to the bill, which the state’s public record indicates drew two witnesses in support of the HB 5238, and no one who spoke in opposition. What were the post-production representatives of the industry thinking and doing?
According to the Associated Press (AP): “Analyzing U.S. tornado deaths from 1996 to 2023, the Associated Press [AP] found that…815 people — were in manufactured houses.” That is some 27 years and that means that some 30.19 people who live in a mobile or manufactured home died on average per year. Here is the math: 815/27 = 30.185. Certainly, any avoidable death is a tragedy. But to put that into context, according to left-leaning Google’s Gemini AI: “In August 2018, the NCBI estimated that the number of bath-related deaths in the United States each year is around 19,000.” That would be about 513,000 over 27 years. If the average number of manufactured home residents during that time was 20,000,000 during those 27 years, that would mean that the odds that someone won’t die during the course of a year from a lethal tornado striking a mobile or manufactured home is 99.99995925 to 1. Pardon me, but aren’t those outstanding odds of survival?
However well-intentioned weather radios in a mobile or manufactured home may be, it is simply doesn’t stand up to careful scrutiny, as what follows reflects. If someone wants one, let them have one. But to legislate this, when Illinois has a Democratic State Attorney General, Kwame Raoul. Raoul was first elected to the office in 2018 and was sworn in January 14, 2019. There have been several civil antitrust cases involving manufactured housing in IL. Why hasn’t the Raoul launched a criminal antitrust case? Raoul has reportedly addressed other forms of housing issues, why not manufactured housing?

2) Given those insights, it is hardly surprising that the bill was enacted into law. Here is the legislative history, per the IL state website.
Synopsis As Introduced
Amends the Illinois Modular Dwelling and Mobile Structure Safety Act. Provides that an installer of manufactured homes must supply a weather radio with specified requirements in each manufactured home installed after 2023. Provides for an annual notice during National Fire Prevention Week to be given by the operator of a mobile home community to replace batteries in weather radios and smoke detectors. Provides installers with immunity from liability for the functionality of weather radios or smoke detectors.

What were the steps taken by IMHA, perhaps in concert with MHI, to avert enactment of House Bill 5238?

4) It is sad, if not worse, that manufactured housing professionals are so poorly represented in so many instances. It is bad enough that manufactured housing associations allow as members, or actively give cover to firms which engage in purportedly predatory operations.
5) But in addition to that, there is apparently nothing on the IMHA website on this date, nor any publicly posted media or other release, per the Google search on 7.22.2024 as shown.
6) Certainly, there is a case to be made that Americans are well advised to know when dangerous weather is approaching, regardless of what sort of structure they happen to call home. But the National Weather Services (NWS) website says the following.

The wireless industry, The FCC, and FEMA will roll-out the WEA’s (Wireless Emergency Alerts) system nationwide this year.
The NWS will start utilizing this by pushing extreme weather warnings over the system in June 2012.
Tornado warnings, flash flood warnings and several other high-end warnings will go direct to wireless users in an affected county automatically if their device is compatible.
So, why is it that some believe that weather radios are needed in the light of the above?
7) It is curious, if not troubling, that MHI previously had a document with “talking points” on this very subject of weather radios. Yet on 7.22.2024, there is now no result for the subject of “weather radio” on the MHI website. Since when did MHI, or at least the IMHA, apparently take the position that no available information on this subject is better than some information? This notion of a ‘need’ for a weather radio has been promoted by some since at least 2011. Ironically, the Associated Press (AP) helped document just how little need there is for this in a practical sense. When an issue like this is raised, it can be handled like a blessing in disguise, by using it as an opportunity to educate the public. That clearly didn’t happen – at least not from IMHA or MHI – in this instance.
8) Step by step, on issue after issue, MHI is being demonstrably revealed as a sham association that serves the interests of often predatory consolidators, but apparently is posturing for all other ‘segments’ of the industry that they claim to represent.
9) According to left-leaning Wikipedia, the governor of IL: “has a net worth of around $3.4 billion. This makes Pritzker the richest officeholder in the United States. He ran as the Democratic Party candidate for Governor of Illinois in the 2018 election against Governor Bruce Rauner.” What is often missed is that more regulations can often be an advantage to larger companies with deeper pockets. The very firms that are often the cause of problematic behaviors toward consumers may ironically benefit from the discussion and passage of regulations that may do little to help consumers.
10) Manufactured housing is underperforming during an affordable housing crisis. Triad Financial Services (ECN) recently said that there are ‘barriers to entry’ in manufactured housing which benefits their business model.
