This proposed HUD rule might potentially be useful for manufactured housing. But as always, the devil is in the details. And as the Manufactured Housing Improvement Act of 2000 (MHIA 2000) or the Duty To Serve Manufactured Housing made law as part of the Housing and Economic Recovery Act (HERA) of 2008 experiences make clear, regardless of what a law or regulation says, what matters in practice is the actual implementation of such laws and regulations.
That noted, MHProNews will provide the HUD press release sent on 6.25.2021 below. HUD PROPOSES RESTORING DISCRIMINATORY EFFECTS RULE
WASHINGTON—U.S. Department of Housing and Urban Development (HUD) Secretary Marcia L. Fudge announced on Thursday that HUD will publish in the Federal Register a notice of proposed rulemaking (NPRM) entitled Restoring HUD’s Discriminatory Effects Standard. The publication proposes to rescind the Department’s 2020 disparate impact rule and restore the 2013 discriminatory effects rule. In its NPRM, HUD states that it believes the 2013 rule is more consistent with decades of caselaw and better effectuates the Act’s broad remedial purpose of eradicating unnecessary discriminatory practices from the housing market.
“We must acknowledge that discrimination in housing continues today and that individuals, including people of color and those with disabilities, continue to be denied equal access to rental housing and homeownership,” said Secretary Marcia L. Fudge. “It is a new day at HUD—and our Department is working to lift barriers to housing and promote diverse, inclusive communities across the country. Today’s publication of the proposed discriminatory effects rule is the latest step HUD is taking to fulfill its duty to ensure more fair and equitable housing.”
The Fair Housing Act prohibits discrimination in housing and housing-related services because of race, color, religion, national origin, sex, familial status, and disability. The discriminatory effects (also referred to as disparate impact) doctrine is a tool for addressing policies that cause systemic inequality in housing. It has long been used to challenge policies that unnecessarily exclude people from housing opportunities, including zoning requirements, lending and property insurance policies, and criminal records policies. Accordingly, having a workable discriminatory effects standard is vital for the accomplishment of the Biden-Harris Administration’s policy goal of a housing market that is free from both intentional discrimination and policies and practices that have unjustified discriminatory effects.
HUD’s 2013 discriminatory effects rule codified long-standing caselaw for adjudication of Fair Housing Act cases under the discriminatory effects doctrine, for cases filed administratively with HUD and for federal court actions brought by private plaintiffs. Under the 2013 rule, the discriminatory effects framework was straightforward: a policy that had a discriminatory effect on a protected class was unlawful if it did not serve a substantial, legitimate, nondiscriminatory interest or if a less discriminatory alternative could also serve that interest. The 2020 rule complicated that analysis by adding new pleading requirements, new proof requirements, and new defenses, all of which made it harder to establish that a policy violates the Fair Housing Act. HUD now proposes to return to the 2013 rule’s straightforward analysis.
The public will have 60 days to file comments on the NPRM. HUD will review the comments, develop responses, and publish a final rule. In the meantime, HUD’s Office of Fair Housing and Equal Opportunity (FHEO) continues to vigorously enforce the Fair Housing Act, including addressing policies and practices by housing providers, lenders, insurers, appraisers, and others that cause unjustified systemic inequities based on race or other protected class.

Additional Information, MHProNews Analysis and Commentary
MHLivingNews underscored the potential for the AFFH years ago. In principle, it might help. The question, as was noted in the headline, is will it? To the HUD tag line above, it is factually obvious that that affordable homeownership is overall in decline since 2000. So, just because HUD says something that does not automatically make it so.
To explore that headline question is this item. It may seem unrelated, but the following from the left-leaning Boston Globe arguably has its parallels in the manufactured home industry. Wally Comer at Adventure Homes and others have told MHProNews that hiring labor with current Biden policies that may pay similarly or more to the unemployed as work might earn them has proven difficult.
With that thought, this is dated 6.25.2021, from the Boston Globe:
“It‘s harder than ever to run a restaurant right now — just when patrons are rushing to come back
Restaurateurs have spent more than a year waiting to get to this moment, when they could finally welcome guests at full capacity, with no restrictions. But now that the opportunity is here, they’re facing a wave of new challenges.
They’re scrambling to find help, hosting on-the-spot hiring sessions, and pleading on social media for staff. They’re raising wages even as costs for ingredients and other goods spike due to global supply chain disruptions.
And after months of subsisting on takeout orders, they’re now turning them away.”
That’s restaurants. But there are manufactured home producers that are several months out on production for similar reasons. That backlog and slowdown in obtaining a replacement home means that independent retailers and non-corporate owned communities may be at a serious disadvantage. That’s on top of the sadly all-too-typical problems that often seem to be caused by public policies, or by the failure to enforce existing laws.
The Texas Manufactured Housing Association (TMHA) said this in an email to MHProNews: “Gov. Abbott Ends Extended Unemployment Insurance June 26.”
The TMHA release added the following:
- Back in late May, Gov. Abbott informed U.S. Department of Labor that Texas will opt out of further federal unemployment compensation related to the COVID-19 pandemic, effective June 26, 2021. This includes the $300 weekly unemployment supplement from the Federal Pandemic Unemployment Compensation program.
- In his announcement, Gov. Abbott stated, “At this stage of opening the state 100 percent, the focus must be on helping unemployed Texans connect with the more than a million job openings, rather than paying unemployment benefits to remain off the employment rolls.”
The Biden-Harris team made numerous promises on ‘healing the country’ and getting the ‘nation back to normal.’ Where is their delivery?
Several of the major brands in manufactured housing which are often MHI members have obvious influence with federal officials from the Biden White House on down. Why haven’t they stepped up and publicly called for the enforcement of good federal laws that would help manufactured housing soar?
HUD – under both Democratic and Republican Administrations – has failed to enforce the Manufactured Housing Improvement Act of 2000. Who says? Kevin Clayton, Lesli Gooch, and others.
The FHFA have failed to properly implement the Duty to Serve (DTS) Manufactured Housing made law by the Housing and Economic Recovery Act (HERA) of 2008. That, per the CFPB, has made manufactured housing lenders owned by Berkshire Hathaway soar in their market share. Who says? Besides the CFPB, ironically, Kevin Clayton in formal testimony to Congress, among others.
The time to look beyond mere words from HUD or any other public officials or dominating brands and look at the action, behavior, and the money trail has come.
