For balance and accuracy, there is talk on the left and the right about more antitrust action. As MHProNews previously reported, and has since reminded readers, White House Resident Joe Biden1, 2 made some potent and at least superficially accurate anti-competitive antitrust comments last year, linked here and here. That noted, GOP Senate Candidate Josh Mandel laid out some tough talk in an exclusive SiriusXM Breitbart News Daily (BDN) interview posted and quoted below.
Per Breitbart, ““Big Tech oligarchs” such as Mark Zuckerberg should be criminally pursued to stop large technology companies’ anti-competitive conduct, Josh Mandel, a Republican candidate running for election to the U.S. Senate to represent Ohio, said on Friday’s edition of SiriusXM’s Breitbart News Daily with host Alex Marlow.”
“You’ve got to go after them criminally because they don’t care about paying fines,” Mandel remarked. “For them, it’s just a cost of doing business, but you see what’s going on with Zuckerberg, right now — the fact that he might have tripped Wisconsin bribery laws with the 400-plus million that he spread around the country.”
He continued, “When they violate any criminal laws, they need to be investigated and prosecuted aggressively because that is, at the end of the day, the only thing that will make them wake up and make them listen and make them change their behavior.”
The U.S. must “take on these Big Tech oligarchs and thugs,” he added.
He went on, “I think part of the strategy needs to be just to attack their absolute power from 100 angles at once. It’s like blitzkrieg, and they won’t know where it’s coming from. We’ve got to attack from different angles simultaneously all at once.”
Big tech such as Facebook and Google should not continue to benefit from liability exemptions provided by Section 230 of the Communications Decency Act, Mandel stated.
“We need to push removing their immunity and exemption from liability in Section 230 and on either code, any other parts of the code, there’s no reason whatsoever that they should have any immunity or exemption from liability.”

MHProNews has in recent years pressed the need for antitrust action to liberate the manufactured housing industry from its over twenty-year malaise. There is a strong case that’s been made that this is caused by a combination of external and internal challenges, which in several instances appear to have a nexus of market manipulation by nonprofits in concert with certain federal officials. Who says? Credible voices such as Minneapolis Federal Reserve researchers such as James A. “Jim” Schmitz Jr. and his colleagues.
So too has affordable housing and manufactured home advocate Doug Ryan before CFED rebranded as Prosperity Now.
Two sources have told MHProNews that a large staff meeting with the Trump DoJ’s antitrust division to discuss antitrust action in manufactured housing. There has been apparent quiet on that since the Biden regime has taken over, but that by itself is not necessarily conclusive.
On the Democratic side, the following lawmakers asked federal officials to investigate Clayton Homes over antitrust and predatory lending concerns.
Beyond Biden, and those noted herein, several Senate Democrats as well as Senate Republicans have been talking about the need for robust antitrust action. Biden recently doubled down on a similar comment to the one cited below.
Perhaps the most comprehensive outsider looking into manufactured housing, Samuel “Sam” Strommen for Knudson Law, laid out the case for antitrust action that includes stripping the Manufactured Housing Institute (MHI) of any claims for Noerr protections.
Ironically, Warren Buffett led Berkshire’s man Kevin Clayton has himself explained how this monopolization is being deployed under the colloquial phrase “the moat.”
With those background insights, and to Mandel’s point, a reminder for longtime readers and stated for the sake of new readers, here is what the Sherman Act provides for, per Cornell University’s law website.
15 U.S. Code § 1 – Trusts, etc., in restraint of trade illegal; penalty
“Every contract, combination in the form of trust or otherwise, or conspiracy, in restraint of trade or commerce among the several States, or with foreign nations, is declared to be illegal. Every person who shall make any contract or engage in any combination or conspiracy hereby declared to be illegal shall be deemed guilty of a felony, and, on conviction thereof, shall be punished by fine not exceeding $100,000,000 if a corporation, or, if any other person, $1,000,000, or by imprisonment not exceeding 10 years, or by both said punishments, in the discretion of the court.”
Also per Cornell’s legal site, “The word “person” or “persons” wherever used in this Act shall be deemed to include corporations and associations existing under or authorized by the laws of either the United States, the laws of any of the Territories, the laws of any State, or the laws of any foreign country.”
Then, there is this.
“(a)
“Antitrust laws,” as used herein, includes the Act entitled “An Act to protect trade and commerce against unlawful restraints and monopolies,” approved July second, eighteen hundred and ninety; sections seventy-three to seventy-six, inclusive, of an Act entitled “An Act to reduce taxation, to provide revenue for the Government, and for other purposes,” of August twenty-seventh, eighteen hundred and ninety-four; an Act entitled “An Act to amend sections seventy-three and seventy-six of the Act of August twenty-seventh, eighteen hundred and ninety-four, entitled ‘An Act to reduce taxation, to provide revenue for the Government, and for other purposes,’ ” approved February twelfth, nineteen hundred and thirteen; and also this Act.
“Commerce,” as used herein, means trade or commerce among the several States and with foreign nations, or between the District of Columbia or any Territory of the United States and any State, Territory, or foreign nation, or between any insular possessions or other places under the jurisdiction of the United States, or between any such possession or place and any State or Territory of the United States or the District of Columbia or any foreign nation, or within the District of Columbia or any Territory or any insular possession or other place under the jurisdiction of the United States: Provided, That nothing in this Act contained shall apply to the Philippine Islands. ”
