Attached, for your information and review, is an MHARR communication to Ms. Sandra Thompson, President Biden’s nominee to become the next director of the Federal Housing Finance Agency (FHFA). Ms. Thompson has been serving as FHFA Acting Director since June 2021, when she replaced Mark Calabria, who had been appointed to that position by President Trump. Ms. Thompson’s nomination to become the official head of FHFA was announce by the White House on December 14, 2021, and will become effective upon confirmation by the U.S. Senate.
As MHARR’s letter indicates, Ms. Thompson’s elevation to the Office of Director is significant because she will become the highest-ranking FHFA official with direct knowledge of: (1) the consumer financing needs of the HUD Code manufactured housing market; (2) the importance of the full and robust implementation of the Duty to Serve Underserved Markets (DTS) within the mainstream manufactured housing consumer financing market; and (3) the baseless, indefensible failure of both Fannie Mae and Freddie Mac to live up to their DTS obligations with respect to the vast majority of lower and moderate-income manufactured homebuyers.
Ms. Thompson was fully informed on all of these issues as a result of a series of direct interactions with MHARR manufacturers and staff in 2020 (when she was serving as FHFA Assistant Director) focusing on the importance of – and urgent need for – full secondary market and securitization support for the manufactured home consumer financing market pursuant to the DTS mandate. These conferences stressed the importance of fully implementing DTS in order to serve the mainstream manufactured housing market and the fully-qualified, yet lower-income consumers who rely the most on the industry’s mainstream affordable homes.
As a result, Director Thompson will bring with her an unparalleled knowledge of – and familiarity with – the specific financing needs of manufactured housing consumers and the various unique aspects of the manufactured housing consumer financing market.
MHARR will work to build upon this knowledge and background in its ongoing efforts to seek the full and necessary implementation of the DTS mandate with respect to all segments of the manufactured housing consumer financing market, as directed by Congress.

On behalf of the members of the Manufactured Housing Association for Regulatory Reform (MHARR), please accept our congratulations on your nomination, by President Biden, to become the Director of the Federal Housing Finance Agency (FHFA).
MHARR, as you know, is a Washington, D.C.-based national trade organization representing the rights and interests of producers of manufactured housing subject to regulation by the U.S. Department of Housing and Urban Development pursuant to the National Manufactured Housing Construction and Safety Standards Act of 1974, as amended by the Manufactured Housing Improvement Act of 2000 (42 U.S.C. 5401, et seq.).
MHARR appreciates and supports your nomination to become FHFA Director because no other FHFA director has had your level of specific knowledge regarding the manufactured housing consumer financing market and the urgent need for robust, market-significant support by the Government Sponsored Enterprises for all segments of the mainstream manufactured housing consumer financing market under the Duty to Serve Underserved Markets (DTS) mandate of the Housing and Economic Recovery Act of 2008 (HERA). We know this firsthand because of your extensive engagement with MHARR and our member-manufacturers in 2020. As we stressed at that time, however, DTS cannot and will not produce the type of positive results directed by Congress for lower and moderate-income American families who rely on manufactured homes, unless and until it includes market-significant levels of support for the personal property (chattel) loans which constitute nearly 80% of all manufactured home purchase loans.
More than 13 years after the enactment of DTS, though, neither Fannie Mae nor Freddie Mac has purchased a single manufactured home personal property loan and neither of the Enterprises currently has a plan or proposed plan for any such purchases. This represents a fundamental failure in the implementation of DTS that will continue to needlessly exclude large numbers of lower and moderate-income Americans from all of the economic and social benefits of homeownership directly contrary to the express intent and purposes of Congress. And while it is not necessarily surprising that Fannie Mae and Freddie Mac would seek to continue their decades-long practice of discrimination against manufactured housing consumers (which DTS was meant to remedy) it is surprising and disappointing that FHFA would continue to directly and indirectly countenance such indefensible conduct. Thus, we hope and anticipate that your nomination will mean a significant change in direction at FHFA with respect to DTS and its implementation.
Accordingly, we ask that you exercise the full extent of your authority going forward to affirmatively require that both Fannie Mae and Freddie Mac end their decade-plus effort to avoid, evade and circumvent DTS within the mainstream manufactured housing market, and finally take steps to begin serving the vast bulk of that market, comprised of mainstream personal property loans, in a market-significant manner, under DTS.
Again, we congratulate you on your nomination, we appreciate your engagement with us in 2020, and look forward to meeting with you again in the very near future to advance real and meaningful change with respect to DTS going forward.

Additional Information, More MHProNews Analysis and Commentary
It remains to be seen what the Manufactured Housing Institute (MHI) has communicated on this nomination. What is known is that superficially, MHI and MHARR seem to hold similar positions. Both assert that they want FHFA to hold Fannie Mae and Freddie Mac to account for their failure to fully and properly implement the Duty to Serve manufactured housing mandate passed by Congress in a widely bipartisan manner.
But when added pieces of evidence are examined, a distinction arises between MHI and MHARR when it comes to DTS, as well as other issues. The case can and has been made that MHI is posturing support for DTS, for instance, but is in fact doing precisely what Doug Ryan with Prosperity Now (formerly known as CFED) alleged. Namely, that MHI is essentially allowing the status quo to exist for the benefit of Berkshire Hathaway (BRK) owned Clayton Homes and their affiliated lenders.
Then MHI executive vice president (EVP), and now CEO Lesli Gooch, Ph.D., denied Ryan’s claim. But the evidence that has emerged since then has supported Ryan’s stance and has contradicted Gooch’s assertions. Facts and evidence are what they are.
Despite various state association executives and counsel publicly genuflecting at the altar of Berkshire, Clayton, their affiliated lending, and MHI, there are those who have pointed out the obvious contradictions – albeit they have often done so quietly.
Manufactured housing, like much of the American landscape, is thus in a struggle that is aptly described as an “information war.” Much of what passes as ‘trade media’ in manufactured housing generally aligns with what MHI says. MHI and their state affiliates has their own network of distribution, which uncritically passes along whatever MHI says.
To the point of information warfare, consider the following.
- MHARR has since they established their website routinely posted the vast majority of what they email out.
- By contrast, MHI began some years ago to restrict the publication of their own messages. It has become an exception for MHI to publicly post on their website what they have emailed out to members and nonmembers.
- That contrast begs the question. Why has MHI engaged for years in hiding their own statements and so-called research?
Additionally, MHARR has flatly said that “the industry” should sue if the looming DOE energy rule is enacted. Note that MHARR’s Danny Ghorbani previously said that MHI should sue to force the issue on enhanced preemption. By contrast, MHI has mentioned that legal action is what caused at least a temporary halt to the enforcement of the Biden regime’s arguably unconstitutional COVID19 vaccination mandate. MHI clearly understands that litigation can and does work. Yet, MHI have yet to engaged in any known litigation, despite their claim of representing “all segments” of manufactured housing.
Restating this is useful and clarifying.
- MHI admits – as does MHARR – that there are laws that would benefit manufactured housing industry growth if they were fully enforced.
- Additionally, MHI – as does MHARR – admits that the looming MHI energy rule could crush the lower cost homes produced for decades by manufactured housing factories.
- But then, why has MHI failed to seek legal action to seek enforcement of these laws, or threatened DOE regulations?
- By contrast, MHARR offered to team up with one or more states to enforce “enhanced preemption.” Those MHI state affiliates demonstrated their stripes by not accepting MHARR’s offer.
- Outsider looking into MHVille should understand that MHARR is a producer’s trade group. By contrast, MHI says they represent “all segments” of the industry. These are post-production issues, yet MHI has apparently failed for years to do the common-sense things that would make their ‘support’ for these laws to move from mere words into reality.

Industry stakeholders and affordable housing advocates welcomed news that the Federal Housing Finance Agency’s acting director, Sandra Thompson, was nominated for the permanent role.
President Joe Biden nominated Thompson for FHFA director on Tuesday. It’s arguably the most important role in housing finance, perched atop the agency that oversees $7.2 trillion in mortgages.
But that doesn’t mean Thompson’s confirmation will come up for a vote anytime soon.
Unlike Consumer Financial Protection Bureau Director Rohit Chopra, Thompson won’t have to wait for a Senate vote to take decisive actions. She is already acting director and has been busy furthering the Biden administration agenda of racial equality. So while she is a much less-controversial figure than Chopra, Congress may not see much reason to prioritize her confirmation.
Some other important nominations have been held up for months, like Julia Gordon, president of the National Community Stabilization Trust, who was nominated to be Federal Housing Administration commissioner in June.
For the time being, Thompson has to weigh how her actions might come across to lawmakers.
Could that put a damper on her push for affordability and expanding access to credit, at least until her nomination goes through? Not likely, according to Bob Broeksmit, president of the Mortgage Bankers Association.” … ##
Thompson has been approached by MHI members and others who are a periodic part of the “housing coalition” that MHI likes to tout when they sign onto something but ignore when what they promote runs counter to the apparent interests of MHI’s dominating brands.
In the dictionary, next to the definition of paltering and posturing without doing what the claim to support for “all segments” of manufactured housing arguably ought to be the MHI logo. MHI is either massively inept, arrogant-ineffective, or corrupt, take your pick. None of them is a good look for the tail end of the Omaha-Knoxville-Arlington axis and their industry allies.
The evidence that years of facts compared to statements is troubling, but clear. It absolutely backs up MHI award winner Marty Lavin’s principles stated to MHProNews, shown below.
It also backs up the statement by Bob Crawford, who with manufactured housing retailing legend Dick Moore sought to launch a post-production trade group.
MHARR formally reported to the industry the need for such a post-production trade group some 4 years ago. While NAMHCO did form in the wake of that MHARR statement, they arguably made some tactical errors by hiring an ex-MHI Vice-President to lead their lobbying efforts. NAMHCO has since gone largely dormant in terms of announcements to the manufactured housing industry at large. That noted, the logic of forming a post-production trade group remains as strong as ever.
MHI is aware of these concerns, because MHProNews has raised these issues directly to MHI, their corporate and staff leaders. Additionally, MHI connected attorneys have flatly stated that they monitor our website (and any critiques of their trade group). MHI have ducked accountability for years without directly denying these evidence-based statements.
But ponder the implication of Goch and Graydon Law – both acting on behalf of MHI – and MHI’s now-former general counsel Rick Robison’s threat to sue MHProNews – for accurately reporting what they said. This is a level of what the Capital Research Center (CRC) aptly has described as “deception and misdirection” which others have said is part of a pattern of paltering and posturing.
The evidence is clear. While MHARR is busy trying to defend their independent manufacturers, and thereby others too, MHI is busy posturing and preening without actually doing what they claim. Tiny House Hands Up (THHU) and the Institute for Justice (IJ) have launched a suit in order to get their rights to affordable housing enforced against Calhoun, Georgia.
Where is MHI’s parallel effort on behalf of manufactured housing?
Where are the other members of manufactured housing trade media in terms of directly and routinely holding MHI to account for their years of apparent failure to do what they claim they want to do?
Facts are indeed stubborn things. But there have been and are efforts underway to bring these troubling trends to a head. It will take time. But simply by holding these facts up publicly for industry and other affordable housing advocates to ponder is in itself a victory of sorts. Because years after threatening MHProNews for reporting accurately what is occurring, MHI has yet to actually do more than threaten us.
Perhaps that is because the truth is a defense for MHProNews/MHLivingNews, but not for MHI and their dominating brands?
An odd dystopian era has existed for some time, but it has come to full light. With Democrats in charge, with Democratic supporting billionaires clearly able to connect with the Biden regime and their officials at any time they wish, why is there still no progress on these key issues and threats to mainstream manufactured housing?
The truth is hiding in plain sight. But it requires discernment to sort out the MHI-connected BS that is echoed by their willing and/or fearful minions to see why manufactured housing has been underperforming during an affordable housing crisis.
The Democratic regime offers an odd but real opportunity. Let them do what they claim.
If they do not, then another layer of metaphorical cataracts is being scraped from the corneas of trusting manufactured home independents and others. Stay tuned to the only authentic manufactured housing “Industry News, Tips, and Views Pros Can Use” © that keeps the truth-bombs and calls for accountability and performance coming.
According to former CNN reporter turned WMAL pundit, Chris Plante, “… the most insidious power that the news media has is the power to ignore.” This appears to be an element of the MHI tactic. But by hammering away with facts, evidence, and the increasingly apparent disconnect between MHI’s claims and their actual behavior, their ability to ignore may become a runway too short for their obscured policies to effectively takeoff. Time will tell if MHI, by one method or another, has to face their critics with authentic accountability.
As an affordable housing crisis rages, manufactured housing is underperforming. MHI can’t avoid the facts that emerge from the evidence of history, and the evidence that comes from their own comments. Perhaps that is why MHI stopped posting their own ‘news’ items? To duck a check of their past claims and thus minimize the risk of accountability?
