For years, the Institute for Building Technology and Safety (IBTS) releases the official data collected on behalf of the U.S. Department of Housing and Urban Development (HUD) monthly report on manufactured housing production and shipment data on the 3rd day of the month. February 2023 data was released on April 3, 2023. For years, the Manufactured Housing Association for Regulatory Reform (MHARR) releases their report on that HUD data the same day. MHARR’s a fraction of the size and budget of MHI, due in part to their difference in focus from MHI. MHARR is focused on ‘production’ issues from the viewpoint of independent producers of HUD Code manufactured homes. MHI claims to be focused on “all segments” of manufactured homes and ‘factory built housing,’ even though there are separate associations that deals with modular housing issues (Modular Home Builders Association (MHBA) and Modular Building Institute (MBI), led by Tom Hardiman). Restated, MHI is the ‘post-production’ trade group for manufactured housing as well as a ‘producers’ trade group that represents the largest brands in manufactured home production. MHARR is production focused.
Hardiman normally steers clear of manufactured housing related issues; he understandably stays focused on modular housing topics. But when Hardiman weighs in, he appears to do so with gusto, as the two previous linked in Part II of this report reflects below.
For years, MHARR has been critical of MHI’s apparently odd behavior, more on that in Part II of this report, further below.
More recently, a law professor issued an insightful and fascinating remark not known to have been reported on by others in MHVille’s routinely pro-MHI bloggers and ‘trade media.’ Only MHProNews/MHLivingNews reported the remark cited below in Part II. There is still more under the heading of additional information with more MHProNews analysis and commentary.
That said, Part I of this report is the bulk of MHI’s latest so-called “Federated States Newsletter dated 4.3.2023. As industry readers, advocates, and others may note, there is no mention that manufactured housing is now in month 5 of a downturn. Yellow highlighting is added by MHProNews. Unpacking and critiquing elements of what follows will occur in Part II.

Help Delay the Manufactured Housing Energy Efficiency Standards Compliance Date
To date nearly 300 industry professionals have called on the Department of Energy (DOE) to postpone the compliance date for the manufactured housing energy efficiency standards, currently scheduled to go into effect on May 31, 2023.
DOE must extend the compliance date for the manufactured housing energy efficiency standards until after the Department’s future enforcement procedures are created and take effect. MHI strongly recommends DOE postpone the compliance date because it is impossible for the industry to know whether or not its compliance efforts will be found satisfactory to DOE without a clear understanding of how DOE will evaluate standards for compliance and how DOE intends to enforce these standards. DOE’s enforcement procedures should be created in consultation with the industry to apply the energy efficiency standards to the realities of manufactured home construction. The industry needs time to understand DOE’s enforcement procedures and prepare their operations to ensure compliance with the energy standards.

It is critical that the DOE hear from all sectors of the manufactured housing industry about the urgent need to postpone the manufactured housing energy standards compliance date. MHI wrote a letter that you can send to DOE by simply inserting your home address and clicking submit. Please share with your members and colleagues.
- Submit a State Association Letter. Thank you to those state associations that have already submitted letters. MHI encourages states to respond directly to the DOE’s request for public comment. To assist you in this effort, MHI has attached a template letter for you to personalize and submit with your comments. To submit your comments, click here and under the “Comment” section type “See attached letter.” Then, upload a pdf version of your letter in the “Attach Files” section and enter your email address and select the box labeled “Organization.” You will then be prompted to select an “organization type” and enter the “Organization Name.” When done, just hit the “Submit Comment” button and your letter will be sent to the DOE.
NEWS FROM WASHINGTON
MHI Calls for Mortgage Lenders and Servicers to Be Exempt from New Rules
In response to two proposed rules from the Consumer Financial Protection Bureau (Bureau) that would impact nonbank entities, MHI called on the Bureau to exempt mortgage lenders and servicers. The first proposed rule would require mortgage lenders and servicers to disclose all form contracts they utilize that seek to waive or limit consumer legal protections. In its letter, MHI stated this rule is duplicative and unnecessary as the Dodd-Frank Act already has requirements in place and would create a compliance burden for mortgage lenders and servicers. If mortgage lenders and servicers are not exempted, MHI called for the rule to be amended to exclude all federal agency mortgage program required forms and to exclude standardized forms required in complying with a myriad of other federal mortgage rules and state laws such as waivers of homestead rights, marital property and consumer property rights, to name a few. Finally, MHI stated the $1 million receipts threshold is too low and a significantly higher threshold is needed. Read the letter here.
The second proposed rule would require mortgage lenders and servicers to submit to the Bureau all legal actions, including agency and court orders, against them. In its letter, MHI told the Bureau this action is redundant and unnecessary as this information is already public and exists on the Nationwide Multistate Licensing System (NMLS), where mortgage lenders and servicers are required to post such information and which consumers can easily search. MHI also expressed concerns with the requirement to designate a senior executive “to attest to the firm’s compliance with covered rules” and the lack of clarity surrounding this obligation. Senate Passes Joint Resolution to Rescind “Waters of the U.S.” (WOTUS) Rule
The U.S. Senate passed a Congressional Review Act (CRA) joint resolution of disapproval that would rescind the Administration’s “Waters of the U.S” (WOTUS) rule by a vote of 53 to 43. This was a bipartisan vote with Senators Rosen (NV), Cortez Masto (NV), Manchin (WV), Tester (MT) and Sinema (AZ) joining Republicans to support the measure. This action follows similar action by the U.S. House of Representatives which passed the CRA last month. The WOTUS CRA resolution now goes to President Biden, who has publicly stated he will veto it. If the President does veto the resolution, a two-thirds vote in both the House and Senate will be needed to override the veto. MHI, along with many housing and business industry groups, have consistently expressed concerns about the definition of WOTUS and have long called for a rule that ends the uncertainty over where federal jurisdiction begins and ends. However, rather than providing clarity, the revised definition continues to create uncertainty for landowners and developers about whether waters (such as ponds and ditches) on their property require them to go through the federal permitting process under the Clean Water Act (CWA).
HUD’s Rule to Address Discriminatory Housing Market Practices Goes Into Effect in May
On May 1, 2023, HUD’s final rule entitled “Restoring HUD’s Discriminatory Effects Standard” will go into effect. This final rule rescinds the Department’s 2020 rule governing Fair Housing Act disparate impact claims and restores the 2013 discriminatory effects rule. MHI previously submitted comments to HUD stressing the importance of fair housing and disparate impact as tools the industry uses to combat localities’ use of zoning and other discriminatory practices to exclude manufactured homes in their community. DOE Offers States and Localities Funding to Adopt More Stringent Energy Codes
As the Administration continues to make climate change and energy efficiency top priorities, the DOE announced it will make $1 billion in funding available to help states and local governments create improved building codes that reduce carbon emissions and improve energy efficiency through the IRA Funded Technical Assistance for the Adoption of Building Energy Codes. The awards will support states and local jurisdictions in adopting, implementing, and enforcing the latest model, zero energy codes, or equivalent codes and standards, including the adoption of the 2021 International Energy Conservation Code (IECC) for residential buildings. Funds will also be awarded to adopt a building energy code that meets or exceeds the zero energy provisions in the 2021 IECC code. Learn more.
HUD Publishes Article Highlighting the Use of American Rescue Plan Funds
HUD recently published an article outlining how states are using funds from the American Rescue Plan to increase affordable housing supply. Over $5.4 billion of the State and Local Fiscal Recovery Funds (SLFRF) have been deployed for affordable housing development and preservation, with a portion of the $16 billion overall allocated for housing-related projects. In July 2022, the Treasury Department expanded the scope of SLFRF funds, which can now be more easily used for the development, repair, and operation of affordable homes. Further, state recipients of these funds are encouraged to use them to make significant investment in order to support and expand affordable housing. The article highlights projects in several states that are utilizing these funds. The projects in Illinois and Massachusetts used SLFRF funds for developing affordable multifamily units. The State of Nevada awarded the Washoe Tribe $5.5 million in SLFRF funds, which will be used for a variety of projects including the new construction of 20 one-story, single-family homes with crawlspaces, porches, and patios. MHI Research Finds Affordability Top Reason for Living in a Manufactured Home
MHI continues to release insights and findings from our recent consumer survey. MHI’s first set of findings are centered on the experiences and sentiments of current residents of manufactured homes. The affordability of manufactured housing continues to motivate homebuyers. Overall, roughly three-fifths (59%) of manufactured home residents cite affordability as one of their top 5 reasons to live in a manufactured home. We recently did a ‘side-by-side’ comparison of MHI vs. MHARR remarks on the DOE issue here, and Danny Ghorbani sounded off on that topic in a popular Q&A at this link here. In no particular order of importance are the following observations.
A) Each of the ‘news headlines’ merits a response from MHI, will they give it publicly? If not, why not? Recall or see what prior MHI chairman Tim Williams said was the plan in his exclusive remarks to MHProNews at this link here. Why hasn’t MHI done exactly what Williams said?
B) The 3rd and 4th headlines above ought to be an embarrassment to MHI for reasons revealed in the fact check, analysis, and commentary linked below.
C) Despite the talk of what HUD or federal officials are doing ‘for’ affordable housing and manufactured homes, the facts reveal that both affordable housing and manufactured homes are in retreat since Biden’s housing plan was unveiled. Why doesn’t MHI stress that point? By contrast, MHProNews/MHLivingNews have documented the facts and evidence step-by-step as it occurred.
D) MHBA/MBI executive director Tom Hardiman has weighed in on MHI and on Biden Housing policies, links as promised in the preface, above.
E) While MHI seems to get involved in supporting conventional housing interests, where are the conventional housing interests in supporting the issues that MHI claims to champion? Can you hear the crickets…?
F) Is MHI giving industry independents the Lemming Treatment? MHI is arguably treating its members and followers like lemmings. How often has MHI asked its followers to sign onto one of their ‘letters’ with no appreciable change in the industry’s status quo? Short answer, too many times in recent years. Additionally, as MHProNews has informed industry members, Regulations.gov says that comments ARE NOT like a vote. While a lot of messages – even similar ones – to a lawmaker’s office CAN BE relevant, a lot of nearly identical messages to a regulator IS NOT.

- In case MHI’s ‘experts’ don’t know, the U.S. Senate issued a report in 2019 suggesting clarifying the points made above and others. Duplicate remarks, fake comments from unreal persons, and several other ‘abuses’ of the federal comments system were identified and condemned in that Senate report.
- The comments quoted below are from Regulations.gov document linked here as a download.
- “Form Letters: Organizations often encourage their members to submit form letters designed to address issues common to their membership. Organizations including industry associations, labor unions, and conservation groups sometimes use form letters to voice their opposition or support of a proposed rulemaking. Many in the public believe that their submitted form letter constitutes a “vote” regarding the issues concerning them. Although public support or opposition may help guide important public policies, agencies make determinations for a proposed action based on sound reasoning and scientific evidence rather than a majority of votes. A single, well-supported comment may carry more weight than a thousand form letters.”
- Oxford Languages second definition for lemming is this: “a person who unthinkingly joins a mass movement, especially a headlong rush to destruction.”
- Dictionary defines being called “a lemming” like this: “a person who follows the will of others, especially in a mass movement, and heads straight into a situation or circumstance that is dangerous, stupid, or destructive”
- Note: MHProNews advising thoughtful people that they are apparently being manipulated or duped is not a slam on the followers. Some may think that they have little or no choice but to do what they are asked. Rather, the ‘lemming’ warning is a concern for anyone who is capable of independent thought and behavior and mistakenly trusts MHI. When the feds (Regulations.gov) and U.S. Senate report (commenting on the Regulations.gov system and its abuses) say form letters (astroturfing, duplicate messages, etc.) are saying don’t do something, why is MHI telling their members to do it anyway?
- It is embarrassing that only 300 members have done what MHI asked. MHI claims they have 1000 plus company/organizational members. That means that less than 1/3 people in every organization responded. To put this in perspective, if this was a serious and legitimate effort, Clayton Homes could put out an internal memo and ask their 20,000 team members (per Forbes) to all send an email. This is arguably part of the Machiavellian, manipulative ploy that MHI has become known for in recent years.
But to better grasp what critics think of as the truly manipulative methods apparently being deployed by MHI and their leaders, see the report linked below. It compares what NAHB and MHARR have said and done to how MHI’s 4.3.2023 email ‘informed’ (or misinformed) their members.
