A legal debate is brewing in a Mississippi court regarding the distinction between a modular home and a manufactured home as it pertains to a restrictive covenant in a subdivision. In a case going back to 2006, developers Hudson Holliday and Darrin Harris filed a complaint to have home owners Betty and Earl Nelson remove their modular home because it violated the covenant that prohibits manufactured housing. The Nelsons maintain it is a modular home, which does not violate the covenant, and have a letter from Hudson Holliday stating a modular home is acceptable. After both parties filed for summary judgment, the court ruled in favor of Holliday and Harris. Leagle tells MHProNews.com the Nelsons are appealing that ruling.
