Washington, D.C. has been declared to be in a state of emergency. We are arguably in a national emergency, regardless if one is declared by President Donald J. Trump or not. It is self evident. But for those who need some evidence, how so? Why are we in a state of emergency?
There is widespread agreement that there are starkly different views of reality. The fact that people of good will disagree on what reality – on events that did or did not occur – is itself clear evidence of systemic institutional failures.
Education, news, big tech/social media, voting, the courts, elected officials, and the various checks and balances of constitutionally limited government have all been tested in recent months. They have each, for various reasons, been found wanting. These institutions have arguably been suffering systemic strain for years.
Ignoring or denying evidence – as opposed to honestly examining and publicly discussing or debating claims – are tactics used by those who know that the evidence is against them.
The way to defeat bad ideas or falsehoods is with good ones that are made clear by robust public debate. Who says? 150 professionals in media and academic professions – individuals who collectively admonished the 45th president – nevertheless believed that robust discussion and debate vs. censorship was necessary.
Facebook, for instance, has announced that it will remove all content that refers to #StopTheSteal. Note that such a bold corporate censorship is also a strike at historic records.
President Trump was accused of inciting followers to storm the Capitol building. But here is the video of what the president encouraged rally attenders. Furthermore, the timeline strongly suggests that those who were listening to the president could not have made it to the Capitol Building. (Note: We’ll see how long Twitter allows this version of the video to stay online).

The premise used to silence President Trump on social media does not stand up to close scrutiny. Furthermore, the fact that actual tyrants such as Nicholas Maduro, Iranian Supreme Leader Ayatollah Ali Khamenei, and other similar leaders have not similar Twitter or social media restraints speak volumes. Khamenei tweeted the following, why is that still up and all of President Trump’s content removed? Consider these examples still on Twitter from Khamenei, posted below. Other examples from different world leaders noted often similarly apply.’

Attorney turned liberal reporter Glenn Greenwald spoke recently of the blinding propaganda that has been deployed on the American people.
What Apple, Amazon, and Google have done to Parler is a self-evidently timed coordinated, high-profile strike at free speech. The argument is made that they are private corporations, so they can do it. But a counterargument exists that they are given a government grant of qualified immunity. They are in that view acting in a quasi-governmental role. If so, then the First Amendment and other constitutional protections should apply.
Those actions by corporate interests were apparently coordinated to benefit the interests of the Biden-Harris team as opposed to President Trump and VP Mike Pence.
Further, the evidence of donations and other support given to the Biden-Harris team that lacks a similar benefit to the Trump-Pence team is relevant in understanding the obvious motivations. In the light of even this brief review, it is apparent that the normal institutional ways of discerning the truth of a topic have been short circuited. The effect is to cut off debate on a topic that roughly half the country believes was a rigged election.
Even after four years of anti-Trump rhetoric by the bulk of big corporate media, President Trump was recently found to be the most admired man in America. Former President Obama came in second. Former Obama-era VP Joe Biden came in a distant third.
President Trump’s public approval remains at roughly the same level, perhaps slightly higher, than it was prior to January 6, per Rasmussen’s daily polling. Rasmussen has a reputation for being more accurate in their opinion surveys.

Against that backdrop, the case can be made that much of what a looming Biden-Harris regime proposes is unconstitutional.
To understand if that is an accurate or inaccurate claim, someone must first understand the U.S. Constitution. Concerns about planned unconstitutional acts announced by the Biden-Harris team will be reviewed further below.
Furthermore, obtaining an office – or anything else – by purported fraud is problematic. The fact that Democrats and so-called RINOs were unwilling to publicly discuss and debate these issues lends credibility to the numerous charges of a stolen election.
The spoliation or destruction of evidence, legally speaking, can incur its own penalties.
The “”Spoliation” of evidence occurs when someone with an obligation to preserve evidence with regard to a legal claim neglects to do so or intentionally fails to do so. Such a failure to preserve evidence can take place by destruction of the evidence, damage to the evidence, or losing the evidence,” says the Matthiesen, Wickert & Lehrer law firm. In federal cases, “The adverse inference to be drawn from destruction of records is predicated on bad conduct of the defendant. The circumstances of the act must manifest bad faith.”
Wikipedia says this: “The theory of the spoliation inference is that when a party destroys evidence, it may be reasonable to infer that the party had “consciousness of guilt” or other motivation to avoid the evidence.” More on this as it relates to the Biden-Harris team is further below.
What that means legally is that destroying or ignoring evidence of fraud or other misdeeds are not a sound defense. The implication may be drawn that “destruction of records is predicated on bad conduct of the defendant. The circumstances of the act must manifest bad faith.” The FBI and others in law enforcement are accused of gathering, hiding, or destroying evidence. Additionally, while not all of the content on social media is ‘historic’ or necessarily legally relevant to recent events, there is on the other hand clear examples of evidence that was potentially useful to lawmakers, public officials, or the public itself. Thus, the destruction of Parler, purging by YouTube, Facebook, Twitter, Instagram, and others of content may indeed fall into the category of spoliation and destruction of evidence.
Representative Devin Nunes (CA-R) said that the apparent collusion between tech companies and other service providers to Parler is actionable under criminal RICO statutes. Rep. Nunes also noted the chilling nature of a threat of how a few large brands could collude to destroy a smaller competitor(s). Nunes estimates that Parler is worth perhaps a billion dollars. If competitors can successfully collude to destroy a competitor, what does that imply for less well funded brands? There are therefore business, informational, and political implications from these recent events.
People of good will of whatever background should be alarmed.
The normally left-leaning ACLU – hardly a Trump supporter – sounded the alarm of this brazen use of raw corporate power. The leaders of Germany and Mexico also sounded the alarm or concerns over the social media bans of President Trump, and German Chancellor Angela Merkel is hardly a Trump fan.

People of faith should pray that at least two things will occur before January 20.
One, that President Trump #DeclassifyItAll.
Second, that he invoke the #InsurrectionAct. If this evidence has been stolen, that is a foundational threat to the American Republic. If so, then military assets could be moved to seize the evidence. Then there should be a focused and robust public debate based upon the evidence. So, the goal should be to do what the other aspects of our system have failed to do, namely, to review the evidence for all to see, discuss, and debate. If evidence has been destroyed, then the law regarding spoilage and related kicks in, more on that further below.
#MAGA supporters of President Trump will accept a legitimate election loss.
What is less likely is that numbers of “patriots” will accept the status quo without a fair hearing of the evidence. At least one of the normal levers of public accountability must review the evidence of claimed voter fraud sufficient to overturn the alleged results of the Trump-Biden contest. Otherwise, millions will be angry. Some will turn to violence, as voices across the left-right spectrum are warning.
Reports of armed protests planned in all 50 states are spreading. 15,000 National Guardsmen are called up to protect the inauguration of Biden-Harris next week.
The path to peace is justice. Sunlight and transparency are required. Justice should come from a public examination and discussion of the evidence.
If Biden-Harris and their backers have nothing to hide, then why should they mind such transparency?
But instead, what we are seeing are heavy handed tactics such as Forbes or other corporations are exhibiting.
Summing up key insights to this point. In a divided nation, what would be ideal is a robust and public debate over what occurred before, on, and after the November 3, 2020 election.
- In terms of possible diversionary tactics, was it mere coincidence that the U.S. Capitol building breech occurred just as Republican lawmakers began making their daytime case for election fraud?
- The lax security on that fateful day speaks volumes. Note in the video below the normal terminology used by media, like “alleged” is for some reason missed. This video was from 1.7.2021 and more facts have emerged since.
The next video is from 1.12.2021, earlier today. It sheds more light on the growing evidence that Capitol police in some cases led those who breached the building into and through the Capitol building. The threat of more violence is also cited. What is not mentioned in this video are numerous claims that Antifa members had infiltrated the Trump supporters too. That noted, there is no doubt that Trump supporters have allegedly crossed legal lines, as MHLivingNews documented an example linked here.
- So does the growing evidence that law enforcement and public officials had a hand in allowing what occurred on January 6th.

Are there too many coincidences and unanswered questions for comfort? Investigators looking into criminal activity as well as reporters and researchers ask a useful question: cui bono? Who benefits? Who benefits from certain behavior, action, or inaction?
What is obvious is that President Trump did not benefit from these events. Who did? Biden, Harris and their corporate backers who are about to take power over the White House, the U.S. House and the U.S. Senate.
Evidence for Election Concerns
- The Amistad Project – which shows the evidence of the influence of Mark Zuckerberg’s donations impact on local elections which purportedly violate various state and/or other election laws. Here is how one of their press releases describes it. Facebook’s Mark “Zuckerberg’s $500 million intervention included a $350 million donation to the Center for Technology and Civic Life (CTCL), which used the money to illegally inflate turnout in key Democratic swing states as part of this effort. This network injected hundreds of millions of dollars into the election, violating state and federal election laws in the process and ensuring an unequal distribution of funding that favored Democratic precincts, depriving voters of both due process and equal protection.” Also, “In addition to Zuckerberg, the main foundations funding the effort to subvert the electoral system were The Democracy Fund, New Venture Fund, Skoll Foundation, and Knight Foundation, according to the report. Key nonprofits involved in distributing the money include CTCL, the Center for Electronic Innovation Research, the Center for Civic Design, the National Vote at Home Institute, the Center for Secure and Modern Elections, and Rock the Vote.”

Why does all of this still matter? Several reasons, beyond a historic record.
As was noted above, if fraud occurred then there are legal principles that fraud is not to be rewarded.
If spoliation, or deliberate destruction or other illicit tactics occurred, then there are still legal remedies. Here is but one of several legal sources that make that point.
“Legislators, public employees, and other public servants may face severe consequences for violating the public trust. The range of penalties includes censure, removal from office, permanent disqualification from holding any state position, restitution, decades in prison, and fines up into the hundreds of thousands of dollars.” Note, “removal from office” is a possible consequence to fraud or violation of the public trust. So says the NCLS website, “National Conference of State Legislatures.”

Some History and How This Relates to Looming #VichyUSA
When National Socialists (NAZIs), Russian Bolsheviks, Communist Chinese, South Vietnamese, Cuban, Venezuelan, or other radical authoritarians came into power, history reflects that it is only a question of when there was a purge of the opposition. The Newsmax video below quickly recounts what happened in Vietnam. But other examples occurred in various nations named and still others.
While the hard left in the USA called Trump a fascist, that was arguably a hypocritical “deception and misdirection” ruse. Black Lives Matter (BLM) and Antifa are clearly examples of behavior more akin to the NAZI brownshirts or that of the Hitler Youth. There was nothing remotely similar among the vast majority of the #MAGA supporting millions. It was BLM and Antifa that had violent protests and riots following the death of George Floyd last May. Floyd’s name is only occasionally mentioned now. But some 2 billion dollars in property destruction and those lost jobs and shopping opportunities, often in minority neighborhoods, remains as the apparent legacy of violence involving BLM and Antifa.
A civil war in America would be fine with Communist China. With a divided America, it is Beijing that has observed that they benefit. Iran is reportedly making moves with Communists in Cuba and the self-described Maduro Socialist regime in Venezuela.
Vice President Pence, who certainly deserves a lot of credit during the last four years arguably let Americans down on January 6, 2021. He as well as several Republicans vowed not to allow socialism to take over in America. The failures of Establishment and weak-knees Republicans speaks for itself. That said, as cowardly and/or treacherous the behavior has been, it is good to recall Ronald Reagan’s words. “My eighty-percent friend is not my twenty-percent enemy.”
Noting that, there should be a “come to Jesus” moment for the sellouts and cowards. Something akin to Peter’s threefold apology after Jesus’ historic resurrection. The swamp is what it is. The system is at the point that it is because for decades, more and more public money flowed to private corporate interests. Of course, that means that deep pocket individuals and businesses are able to wield enormous influence in Washington, D.C. but also at state houses too. This is a sad consequence of winking at constitutional provisions that arguably prohibited such behavior. But that is another topic for another time.
The risks of the looming “President Select Joe Biden*” regime are too many to enumerate. But let us list a few to clarify the issues that lie ahead, in order to shed light on what might still be done if President Trump decides not to invoke the Insurrection Act to #StopTheSteal. Following this partial list will be the first in a periodic series of important topics on possibly critical next steps.
- “Vice President-Select Kamala Harris*” and “President-Select Joe Biden*” have made it clear that there will be a full assault on the National Rifle Association (NRA) and on gun owners and manufacturers rights. Even non-gun owners and all business owners and investors should be alarmed. If public officials feel it is okay to declare limit or ban a product or service, what does that imply for professions like ours?
- The southern border with Mexico already witnessed a surge of illegal crossings. If a Biden regime becomes reality, they have made pledges to turn undocumented people into citizens. What that process or time line might be is not clear. But turning millions – perhaps 22 million (+/-) into voters would give Democrats a national edge that combined with other points that follow, may never allow another Republican or other political candidate to come to national office. Numerous red states would become purple or blue too.
- Loss or limiting of religious and other constitutionally liberties, such as free speech and the freedom to earn an honest living.
- Build Back Better – “the Great Reset.”
There is much more, but these should be sufficient for these and other reasons.
- Illegal drugs, human trafficking, and other criminal activity will only surge if the southern border is ‘opened up’ without controls.
- Smooth paths to citizenship for those who entered the U.S. illegally should not been handed out like toilet paper. Making citizenship easy or encouraging the violation of our entry and immigration laws are all the more important during a pandemic. It should be earned. Mass citizenship to some 20 million (+/-) people, when we handle about 1 million a year legal immigrant now defies credulity for realistic processing.
- Loss of any constitutional right is to be feared when taken without due process of law. Passing an unconstitutional law or regulation is historically viewed by the courts as a non-law. How many unconstitutional non-laws have been witnessed in the past year? As now former Attorney General William Barr noted, a health crisis is not an excuse to violate the constitution.

The Texas lawmaker below is making the argument for succession from the United States. He says he is getting calls from other states about this possible move by the so-called red states to split from the blue states.
To be clear, such a move has tremendous international risks, as Communist China or Russia would no longer be facing a United States but rather divided states.
Let’s pivot some of the words of President Trump that have been censored by the tech giants are as follows.
“We must get on with the business of America.” – President Trump White House video 1.7.2021.
“Serving as your president has been the honor of a lifetime. And to all of my wonderful supporters, I know you are disappointed, but I also want you to know that our incredible journey is only just beginning.” – President Donald J. Trump, 1.7.2021.
“Even though I totally disagree with the outcome of the election, and the facts bear me out, nevertheless there will be an orderly transition on January 20th. I have always said we would continue our fight to ensure that only legal votes were counted. While this represents the end of the greatest first term in presidential history, it’s only the beginning of our fight to Make America Great Again!” – President Trump, via @DanScavino, 1.7.2021.
Presuming for discussion sake that there is no invoking of the #InsurrectionAct, as some hope, what will constitutionally minded citizen be faced with if a President-Alleged Biden takes over without proof that he honestly won the election?
The promises (or threats) of unconstitutional behavior on issues like the 2nd Amendment or failure to defend America’s borders makes it clear that the risks are many.
In the first in a periodic series, we will take another quick look at the importance of jury rights.
The first example is historic, from the New York Personal Injury Attorney Blog, and it goes to the issue of protected speech that is so prevalent today.
Quoting that legal site: “In the 1600s William Penn was arrested for an “illegal” speech. The jury acquitted Penn, which enraged the colonial judge. So the judge imprisoned the jury for a few days to help “persuade” them to reach a verdict more to his liking. The jury refused and their imprisonment was subsequently overturned. Thus, the power of the jury was established, free of the opinions of the judge. (See: Bushel’s Case)”
He goes on to say that “Juries are supposed to be finders of fact, and apply those facts to the law as given by the judge. But sometimes juries don’t like the law and do what they want. While in civil cases a jury verdict can sometimes be reversed, in criminal cases a defense verdict ends the case for all time.”
He provides “A few quotes to ponder:
- “The jury has the power to bring a verdict in the teeth of both law and fact. — Oliver Wendell Holmes, United States Supreme Court Justice
- The jury has a right to judge both the law as well as the facts in controversy. — John Jay, 1st Chief Justice of the Supreme Court
- The pages of history shine on instances of the jury’s exercise of its prerogative to disregard instructions of the judge — S. vs. Dougherty, 1972
- It would be an absurdity for jurors to be required to accept the judge’s view of the law, against their own opinion, judgment, and conscience. — John Adams”
What that says is that a juror can personally vote “not guilty” and thus blunt or entirely stop an unconstitutional or other type of prosecution.
The juror can judge the justice of the charge but also if the law in question is proper, legal, and fair. The juror may or may not want to explain to fellow jurors why he will vote as she or he wants. But a single juror can stop a conviction for an unjustified charge or an illicit law.
To be sure, judges routinely hate “jury nullification.” They will routinely instruct juries to follow the judges view of the law. But that does not mean that the judge is a god. A judge is a mere mortal. Again, for emphasis.

If an authoritarian #VichyUSA becomes reality, jury rights will be more important than ever. The willingness of an informed citizen to serve on a jury is in several ways a powerful “vote” that compliments the vote at the ballot box, which we’ve seen may be compromised.
- The day may come when someone is being threatened with the loss of their property or liberty, which may be a gun that was not used in the commission of any crime.
- The day may come – if the Great Reset gains steam – when someone who does not want to surrender their home is charged with some unconstitutional offense.
- They day may come when someone who simply wants to attend their religious services is charged with a crime (this has already occurred). A juror(s) can either stop or acquit the accused.
Good information will be ever more important if #VichyUSA becomes reality. The norms before COVID19 are gone. What is being promised is the opposite of ‘build back better.’ It is rather a new feudalism where the wealthy elites will have property and rights, and the rest of society will only have those rights that they are allowed to keep.
As Chris Plante with WMAL noted recently, it will be in some ways more authoritarian fascism akin to Nazi Germany than to Soviet style communism. In the sense that corporate interests helped bring Adolf Hitler to power in Nazi Germany, Plante has a point.
To draw to a close for this report and analysis, the following thought applies. Yes, too many of our lawmakers failed us before or on January 6, 2021. Reportedly tens of millions of messages were sent to lawmakers. Most ignored them.
But some may now be coming to realize just what harm is looming. It is never too late for a lawmaker or public official to do an about face and work to keep their oath of office to protect the country against all threats, foreign and domestic.

The institutions of our nation have been subverted. Without the rule of law, then all else that people do becomes threatened.
That’s a national crisis.
But throwing up one’s hands is not the solution. There is more clarity now on who is who than there was a year ago.
There is a foundation for a lawful new birth. But it is dressed in overalls, and will only occur with serious work. That begins with understanding and then passing that understanding on. To learn more, see the related reports.
Despair or frustration are not solutions. Hope without action, or ignoring reality, are not a solutions either.
