Long-Awaited “Duty to Serve” Proposal Unveiled

MHARRThe Federal Housing Finance Agency (FHFA) announced, at the June 2, 2010 Elkhart, Indiana industry finance summit meeting, the release of its long-awaited proposed rule to implement the “duty to serve underserved markets” (DTS) provision of the Housing and Economic Recovery Act of 2008. The unofficial text of the proposed rule, which (as of June 3, 2010) has not yet been published in the Federal Register, is available through a link at the conclusion of the attached June 1, 2010 FHFA News Release announcing this action (see, attachment).

“Formaldehyde Standards for Composite Wood Products Act” Update

This week, the House Energy and Commerce Committee approved, the “Formaldehyde Standards for Composite Wood Products Act” (HR 4805), a bill that would require all finished wood products to comply with California’s CARB standard for formaldehyde emissions by 2012. MHI was successful in having the bill amended to provide that HUD as opposed to EPA would continue to regulate formaldehyde standards for manufactured housing. It requires the Secretary of Housing and Urban Development (HUD) to update regulations on formaldehyde emission controls for certain wood products used in construction of manufactured homes to ensure that they reflect the formaldehyde emission standards established by this Act. At MHI’s urging, the legislation states that the effective date for manufactured and modular homes shall be based on a designated date of manufacture of the finished good, rather than a “sell-by” date whereby all existing inventory which does not comply with CARB must be sold.

HUD-MHARR Meeting – SAFE Act Legislation Introduced

I. MHARR OFFICIALS MEET NEW HUD PROGRAM MANAGEMENT

MHARR officials, including members of the association’s Executive Committee and staff, met on May 24, 2010 with HUD Associate Deputy Assistant Secretary Teresa Payne, recently appointed the new manager of the HUD manufactured housing program.

Given the fact that manufactured housing finance issues are scheduled to be addressed in detail at a June 2, 2010 roundtable meeting in Elkhart, Indiana, being jointly hosted by Congressman Joe Donnelly (D-IN) and Federal Housing Commissioner David Stevens — a meeting that MHARR will attend and participate in — this first MHARR meeting with the new program leadership focused specifically on issues related to the Title VI manufactured housing program.

MHI’s Energy Efficient Manufactured Housing Legislation Passes the House

Last night, Congressional leaders passed legislation to help stimulate the economy and increase energy efficiency. The Manufactured Housing Institute (MHI) strongly advocated for the passage of an amendment offered by Rep. Baron Hill of Indiana on Energy Efficient Manufactured Housing which was attached to H.R. 5019, the Home Star Energy Retrofit Act of 2010. The House of Representatives passed the bill by a vote of 246-161, largely along party lines. The legislation will now be referred to the Senate for consideration. For final vote results click here.

MHCC at Brink of Destruction as HUD Attempts to Render it Irrelevant

I. MEETING OVERVIEW AND ANALYSIS

The cumulative impact of years of mismanagement of the HUD manufactured housing program under its prior leadership was on full display as the Manufactured Housing Consensus Committee (MHCC) met on April 28-30, 2010 in Tulsa, Oklahoma. Building on a series of actions initiated and advanced by HUD during the past several years, the role, authority, functionality and independence of the MHCC has, for now, been replaced by de facto HUD domination, in both procedure and substance. These actions, designed to effectively transform the MHCC into a rubber stamp for the HUD program — similar to the former National Manufactured Housing Advisory Council disbanded by Congress as part of the Manufactured Housing Improvement Act of 2000 and replaced with the MHCC — culminated at the Tulsa meeting
