Per the State of Washington’s Attorney General Bob Ferguson’s (D) is the press release, posted below in Part I. It announced, “approximately $400,000 in restitution is on its way to current and former residents of an Ilwaco mobile home park.” While a state specific action, it may have national implications. Owners issued unlawful eviction and utility shut-off notices to residents
OLYMPIA — Attorney General Bob Ferguson announced today that approximately $400,000 in restitution is on its way to current and former residents of an Ilwaco mobile home park. The owners, Michael and Denise Werner and their companies, including Deer Point Meadows Investments, are paying nearly $1.1 million as part of a legally binding resolution to Ferguson’s consumer protection lawsuit over the Werners’ unlawful eviction and utility shutoff notices.
In 2022, the Werners and their agents distributed eviction and utility shutoff notices to residents of the Beacon RV mobile home park, signed by “Management,” despite not yet owning the park. While distributing the notices, two of the agents were visibly armed with firearms.
In written communication, Denise Werner described the Beacon RV residents as “filth.” Michael Werner stated he was not concerned about the Beacon residents’ rights and that he did not believe the law applied to him.
A judge in Pacific County Superior Court previously ruled the notices were unlawful. The legally binding resolution requires the Werners to pay back their current and former tenants, plus interest, as well as covering the costs of the Attorney General’s investigation and enforcement.
The approximately 40 current and former tenants will receive a letter from the Attorney General’s Office explaining the resolution. Each tenant will receive a check for $10,000. This is in addition to $57,000 in administrative fines from the Attorney General’s prior enforcement for violations of Washington’s Manufactured/Mobile Housing Landlord Tenant Act, and a court order to provide $2,000 or actual relocation costs to tenants, whichever is greater.
“This resolution gives significant relief to tenants — many of whom are elderly, disabled, low-income or veterans — and provides accountability for the park owners’ illegal conduct,” Ferguson said. “Washington law is clear: Mobile home landlords must deal fairly with their tenants. My office will continue to be a watchdog for Washingtonians.”
Ferguson filed a lawsuit in Pacific County Superior Court asserting the Werners violated the Consumer Protection Act and Manufactured/Mobile Housing Landlord-Tenant Act during their purchase and operation of Beacon Charters and RV Park.
The Werners are based in Vancouver, Wash., and own and operate dozens of mobile home and RV parks across the state. Approximately 4,000 people live in those parks.
On April 11, 2022, the Werners purchased Beacon, intending to convert the park to short-term rentals. Prior to completing the sale, the Werners began issuing eviction notices to Beacon’s 45 long-term residents on Feb. 25, 2022. The notices were signed by “Management.”
On April 6, 2022 – still prior to owning the park – the Werners issued a utility shut-off notice, also signed by “Management.” The former CEO of Deer Point testified that this was “standard practice” for the Werners. The Werners attempted to shut off the power, but the local utility provider refused.
Judge Katherine Svoboda, a Grays Harbor judge who presided over the case in Pacific County court, ruled that the notices were unfair and deceptive, in violation of the Consumer Protection Act. When issuing the notices, and subsequent notices around the park, two of the Werners’ employees were visibly armed with firearms, at the direction of Michael Werner. In addition, the Werners had refused to keep the park clean and safe, as required by law, allowing a rat infestation, piles of garbage and feces-smeared bathroom facilities.
One resident said people at the park were “shocked and scared.”
An 81-year-old resident who has lived at the park for eight years said she “worried we might get kicked out onto our butts in the street. … How on Earth can [the Werners] do that legally?”
A 78-year-old resident undergoing cancer treatment said she saw “rats running all over the place. … I had to borrow money for a lot of things” in order to move.
In response to the Werner’s notices, a majority of the Beacon residents were forced to leave the property. Some Beacon residents feared for their safety, believing the Werners would kick them out on the streets or tow away their homes.
One Beacon resident feared having an eviction on her record, which could prevent her from securing low-income housing.
Another Beacon resident was prevented from seeing his young child because of the Werner’s threats of utility shut-off and safety concerns stemming from the Werner employees openly carrying firearms. Some Beacon residents experienced physical harm from the stress and physical exertion required to move their homes, requiring hospitalization and ongoing care.
Other tenants had difficulty finding parks with availability to accept their mobile homes.
Manufactured Housing Dispute Resolution program helps tenants and landlords
The Attorney General’s Manufactured Housing Dispute Resolution Program received 13 complaints from 10 tenants at Beacon.
The Legislature created the program in 2007 to help enforce Washington’s Manufactured/Mobile Housing Landlord-Tenant Act (MHTLA) and help resolve disputes between landlords and manufactured home owners. The act applies to situations where the tenant owns their manufactured or mobile home, but rents the space the home sits on.
Both landlords and tenants can file complaints with the program. The program serves as a neutral party, not an advocate for either side.
The law directs the program to attempt to bring parties into compliance with the law prior to taking enforcement actions. Enforcement can include administrative measures and litigation.

The following is according to Wikipedia.
Kirkpatrick published articles in political science journals reflecting her disillusionment with the Democratic Party with specific criticism of the foreign policy of Democratic President Jimmy Carter. Her most well known essay, “Dictatorships and Double Standards“, was published in Commentary magazine in November 1979.[11] In the essay, Kirkpatrick mentioned what she saw as a difference between authoritarian regimes and the totalitarian regimes such as the Soviet Union; sometimes, it was necessary to work with authoritarian regimes if it suited American purposes:[4] “No idea holds greater sway in the mind of educated Americans than the belief that it is possible to democratize governments, anytime and anywhere, under any circumstances … Decades, if not centuries, are normally required for people to acquire the necessary disciplines and habits. In Britain, the road [to democratic government] took seven centuries to traverse … The speed with which armies collapse, bureaucracies abdicate, and social structures dissolve once the autocrat is removed frequently surprises American policymakers.”[1]
The Economist writes that until then [i.e.: serving Ronald Reagan as a foreign policy adviser during the 1980 campaign], “she had never spent time with a Republican before.”[1]
Part III – Additional Information with More Analysis and Commentary
1) Briefly about Part I. There are X number of land lease manufactured home communities that ought to be concerned about their own policies with respect to the action by Washington state’s Attorney General Bob Ferguson. Per left-leaning Wikipedia: “Robert Watson Ferguson is an American lawyer and politician serving as the 18th attorney general of Washington. A member of the Democratic Party, he was first elected in 2012 and re-elected in 2016 and 2020. Prior to being attorney general, Ferguson was a member of the King County Council.”
2) Pivoting toward Part II. Some in or beyond MHVille may at times misunderstand, misconstrue, or twist the words or intent of this writer and the management of MHProNews. We are political independents and have been for over a decade. There were times this writer was registered with a political party, but that was for the purposes of voting in a party’s primary in a closed primary state. For years before and since, it was and remains our position that the Democratic and Republican Party duopoly can be harmful to the interests of most Americans, and that ballot access should be easier for so-called third-party candidates. We believe in presenting information accurately, citing sources accurately, and showing political bias accurately. By doing so, readers can better understand and navigate their industry and world. There are good things, bad, and meh said or done by people of all backgrounds and persuasions. The truth can be uttered at times by someone who may be seen by some as having a problematic history. Just because someone disagrees with some or much of what a person has said or done doesn’t mean that certain things they said or did is useful, insightful, or true. Some examples follow.
3) Democrat Jeane Kirkpatrick’s Famous Remarks “Blame America First” and “The Press in this country is no longer on the side of the governed, it has become a partisan of the governing class.” Kirkpatrick was well educated. She spent years involved in leftist, Marxist, and Socialist politics. For those who need some clarification, Marxism, Socialism, and Communism are interlinked, per that movement’s own leaders. Karl Marx, the co-founder of what became the start of socialist and communist movements and where the name “Marxist” comes from, said the following.
4) As was noted above, Kirkpatrick spent years in the political left. Yet per the left-leaning Economist and Wikipedia, Kirkpatrick never spent much time with a Republican until the Reagan campaign in 1980, when she acted as his adviser of foreign policy. One must keep in mind that Reagan himself was a Democrat who turned Republican. As the doctor dissertation linked here stated, the highly educated Kirkpatrick ‘evolved’ in her thinking on politics, economics, etc. So too have millions of others.
5) It isn’t new that socialism, Marxism, and communism is seen as fashionable and by sizable parts of our population as ‘superior’ to capitalism. But there is a case to be made that that is a false choice. Capitalism is not necessarily the same thing as free markets. There can be crony capitalism and an array of types of capitalists that range from benign to vulture capitalists.
6) Kirkpatrick left her Marxist-Socialist-Communist ties behind during her “evolution.” Her quote above, for example, on the importance of the Solidarity movement in Poland during the Cold War era is quite insightful (see Part II), as are other insights. Those who come to the U.S. after having lived under socialism or Communism are routinely anti-socialist and anti-communist. While some do a good job of educating youth in these topics, there is evidence that tens of millions of young people who have been improperly informed on the history of ‘modern’ era (20th and 21st century) authoritarian regimes.
7) We currently have 2 candidates running as Democrats to be the next president and vice president of the United States, Kamala Harris (D) and Governor Tim Walz (MN-D), who have clear ties to Marxist, Socialist, and Communist ideologies. Walz brags about his numerous trips to communist China. He is on video oddly saying that one person’s socialism is another person’s neighborliness. Meaning, he is painting a picture of a benign socialism that is at stark variance with the authoritarian realities of several socialist-communist societies in the last 100 years. It must be recalled that Nazis were socialists who were fascists, as was Italy’s Benito Mussolini.
8) Kamala Harris was literally raised by a father who taught Marxism. She was rated the most-leftist U.S. Senator, supposedly even more to the left than self-described Democratic Socialist Senator Bernie Sanders, who has run for president as a Democrat. Communists and socialists made the decision decades ago to infiltrate the Democratic Party which they felt was more open to their thinking.
9) MHProNews doesn’t need to be an expert on the life of Democratic candidates Harris or Walz in order to access the research of others into Harris or Walz. It will be recalled that in 2020, MHProNews provided the research of Trevor Loudon, a New Zealander who came to the U.S. precisely to be on the front lines of what he saw as the threat of a sly Marxist-socialist-communist effort to take over the U.S. from within that used the Democratic Party as its main vehicle of choice. Loudon didn’t just make allegations. He interviewed those who had documents, facts, experience, and evidence. Note that Loudon said that former Senator Joe Biden (DE-D) was far more to the left than the moderate he was being painted as being by many in the media. The fact that self-described Democratic Socialist Bernie Sanders embraced and supported Biden speaks volumes. The fact Democratic Socialist says that Kamala Harris hasn’t change her (leftist) values, she is apparently posturing, he implied, in order to win a campaign.
