Sun Communities’ Lawsuit against Resident Dismissed

A lawsuit filed by Southfield, Michigan-based Sun Communities, Inc. (SUI) against the owner of a manufactured home in Southwood Village Mobile Home Park alleging the owner did not give Sun an opportunity to match an offer or be the highest bidder has been dismissed. While both sides are barred from discussing the case with the media, according to fox17online.com, the suit revolves around a new “right of first refusal” policy that took effect Jan. 1, 2014. Sun had sued for $25,000, but with dismissal of the suit the buyer subsequently moved the home out of the community.

Another resident, April Johnston, who wanted to sell her home received an offer for $5,000 from an outside buyer but was allegedly told she had to offer it to Sun first. She said the company told her it was not worth anything, “That we needed to just give it to them for free,” according to her. When asked why she did not just take the $5,000, she replied she wanted to avoid the court issues. MHProNews.com has learned fox17 contacted the corporate office and was told to submit questions to the human resources department in writing. ##
