According to the media release from the National Federation of Independent Business (NFIB) to MHProNews: “After several years of proposed regulations and discussion, the U.S. Department of Labor has issued a new federal overtime rule that is set to take effect July 1, 2024. Under the new rule, employees who make less than $43,888 on July 1, and then $58,656 on January 1, 2025, will be eligible for overtime pay. The rule applies to the Fair Labor Standards Act’s white collar “executive, administrative and professional” exemptions.”

The so-called EAP exemptions determine which employees are exempt from overtime-pay requirements under federal law when they work more than 40 hours in a week. Part II
According to the U.S. Department of Labor are the following insights on the changes to the overtime rules that will impact businesses and certain employees. Their information states the following.
Employees are exempt from the Fair Labor Standards Act’s minimum wage and overtime protections if they are employed in a bona fide executive, administrative, or professional capacity, as those terms are defined in the Department’s regulations at 29 CFR part 541. To fall within the EAP exemption, an employee generally must meet three tests:
- be paid a salary, meaning that they are paid a predetermined and fixed amount that is not subject to reduction because of variations in the quality or quantity of work performed;
- be paid at least a specified weekly salary level; and
- primarily perform executive, administrative, or professional duties, as provided in the Department’s regulations.
The Department’s regulations also provide an alternative test for certain highly compensated employees who are paid a salary, earn above a higher total annual compensation level, and satisfy a minimal duties test.
The final rule will increase the standard salary level and the highly compensated employee total annual compensation threshold on the rule’s effective date on July 1, 2024, and on January 1, 2025, when changes in the methodologies used to calculate these levels become applicable. The final rule also provides for future updates of these levels every three years to reflect current earnings data. These scheduled increases are displayed below.

Earnings thresholds for the Executive, Administrative, and Professional exemption from minimum wage and overtime protections under the FLSA
The Department’s regulations require executive, administrative, and professional (EAP) employees to be paid at least a minimum salary amount to be exempt from the Fair Labor Standards Act’s minimum wage and overtime requirements under section 13(a)(1). In April 2024, the Department issued a final rule increasing the standard salary level for exemption, and the total annual compensation requirement for highly compensated employees, as detailed below.

Part III – Developments and Updates Unrelated to the New Overtime Rules

5) Mockery by Bongino, RNC Research, or others aside, what is difficult to factually and rationally dispute is that tens of millions of Americans are poorer now than 4 years ago. Millions can’t buy a home that previously could qualify. Millions can’t qualify to buy the home they currently live in if they had to buy it at today’s prices. Perhaps 10 million illegals have entered the U.S., some of whom are on terror watch lists. Others are of ‘military age’ from places like certain Middle Eastern nations, Venezuela, or Communist China. The America we knew is being undermined by either an incompetent and/or treacherously traitorous man who sits in the Oval Office.
6) Could the opposition party to the Biden-led Democrats be stronger? Absolutely. Are there some among the Republicans who are weak kneed and also influenced by the billionaire class that placed Biden in the White House in the first place? Yes. But as Bongino points out, elections are routinely binary choices. There are those who obviously support Biden and his methods, and those are Democrats backed by what leftist Michael Weinstein called “Corporate Democrats.” They make promises that they fail to deliver on, said Weinstein. It is the illusion of helping the little guy, said Weinstein, that keeps people voting for Democrats – and Weinstein is from the left.
7) Freedom isn’t free. Ignorance and freedom are not compatible with each other. While MHProNews often goes deeply into issues for those who want to understand the nuances, there are those with the gift for soundbites and snapshots. Between small dollar donors and mega-donors, the Trump campaign has raked in hundreds of millions of dollars since the verdict. Per the campaign, about a third of those small dollar donors have never given previously. Bongino asserts, with evidence, that when someone donates, they are also likely to follow with their vote.
8) MHProNews has been reporting for some years that ‘business as usual’ is dead and gone. We didn’t must make that up, others in the billionaire and big corporate class have publicly made that assertion. Furthermore, when the billionaire and big corporate class is saying that MAGA is the enemy, it is clear why they perceive that Trump is a threat to their power over the U.S. economic and political system. If Biden-Democrats are the apparent preferred choice for the oligarchs and plutocrats, then it should be common sense that supporting Trump and Republicans (in general, not universally) is the preferred choice for those who want authentic change vs. empty rhetoric.
9) It isn’t a given that a Trump 2.0 would implement the Manufactured Housing Improvement Act (MHIA) of 2000’s “enhanced preemption” and other languishing provisions. But what is clear is that Biden, who voted for the MHIA, and his fellow Democrats have demonstrably NOT supported the industry, despite years of happy talk about and to manufactured housing.
9) Poverty is spreading under Biden. Middle class buying power is eroding under Biden. Small businesses are suffering under Biden. Even with some crimes going underreported, the surge in crime under Biden is apparent.
10) The Manufactured Housing Institute (MHI) may as well hang a shingle out that says, we are for bigger businesses that are consolidating manufactured housing and are keeping the industry underperforming during an affordable housing crisis. Even AI powered Copilot (see 2nd link below) has poked fun at MHI, after previously saying that they appear to be guilty of false statements that could be defined as lying, paltering, and deception.
11) While it may not sound like a defense of MHI, in fairness, what they appear to be doing is posturing one thing, while doing another. It is part of the broader pattern of numbers (not all) larger businesses and several in the big billionaire-big corporate class. MHI leaders and their outside attorney have again declined to comment on these evidence-based concerns and allegations.
12) A president and bureaucracy willing to enforce existing laws is what is necessary. That’s why the topics linked below are relevant and important. Project 2025
